Monday, July 6, 2009

 

CALL TO ORDER: Regular Business Meeting

Mayor Don Kirby called to order the Regular Business Meeting for the Union City Commission on Monday, July 6, 2009 at 7:00 p.m.

 

Present: Mayor Don Kirby, City Commissioners Bob Kelly, Todd Sayers, and John Mefford.  Also, City Attorney Greg Voss, City Engineer Barry Burke, (FOPPE Technical Group) and Kathy Porter (City Clerk/Treasurer).  Absent: Commissioner John Adams. Ten (10) citizens signed the attendance sheet.

 

MINUTES: (All Commissioners were provided a copy prior to tonight’s meeting)

Commissioner Sayers moved to accept the REGULAR BUSINESS MEETING MINUTES of Monday, June 8, 2009 and the motion was seconded by Commissioner Mefford.  Motion carried. 

 

TREASURER’S REPORT: Commissioner Mefford moved to accept the Treasurer’s Report as of June 30, 2009 as presented.  Commissioner Kelly seconded the motion.  Motion carried.

 

UNION CARES PROGRAMJuly – Vineyard Christian Church

Commissioner Kelly stated the representative from Vineyard Christian Church was not in attendance.  Mayor Kirby stated there is information on the website describing the program and how the city partners in helping.

       

CORRESPONDENCE:   

Bid opening of Waste Services.  The city received two (2) bids for City Waste Collection.  Rumpke of Kentucky, Inc. submitted the following:  Trash Collection Rate - $8.40 per unit per month.  Total invoiced quarterly - $42,714.00.  Total invoiced yearly - $170,856.00.  Recycling rate (billed to city) $2.15 per unit per month.  $10,932.75 per quarter.  $43,731.00 per year.  Subscription recycling rate per unit per month $3.95 for 18 gallon or 65 gallon tote.  Bavarian submitted the following:  Trash Collection Rate - $9.00 per unit per month.  Total invoiced quarterly - $45,765.00.  Total invoiced yearly - $179,398.80.  Recycling rate $2.95 per unit per month.  $15,000.75 per quarter.  $60,003.00 per year.  Subscription recycling rate per unit per month $4.25 for 18 gallon or 90 gallon tote.  Mayor Kirby stated that the figures presented by Rumpke are within the city’s budget.  Mayor Kirby asked to hear a motion granting waste collection and recycling bid to Rumpke of Kentucky, Inc.  Commissioner Sayers made a motion to accept the bid.  Commissioner Mefford seconded.  Motion carried. 

 

EAGLE SCOUT RECOGNITION:

Mayor Kirby read a Proclamation honoring Kevin Hoeben, Boy Scouts of America, troop 805, in recognition of his receipt of the highest rank in the Boy Scouts, that of Eagle Rank.   

 

CITY ENGINEER REPORT: Mr. Barry Burke with Foppe Technical Group presented the City Engineer’s Report.  (All Commissioners were provided copies prior to the meeting).  Sanitary Sewer Systems – near 50% complete.  Work will go much faster once there is a break in the rain.  Hempsteade repairs underway and going well.  Mayor Kirby stated how well the work looks thus far.  Speed humps are causing some resident complaints.  There have been questions regarding height and speed. The driveway apron and sidewalk damage at resident Meihaus’ home documents forwarded included insurance compensation of $2,100.00 for damages.  There is a $1,000.00 balance that will be forwarded to Kathy Porter, City Clerk, for reimbursement, as previously authorized.  Regarding the Union Community Center/former fire hall, city representatives and inspectors from the fire department came out to meet with building inspector and the fire department regarding the extent of the work required for a Change of Use permit.  Following a question from Mayor Kirby, Mr. Burke stated the mapping will be prepared based upon existing conditions.  Section 34 of the building code will also be reviewed.  The mapping will then be forwarded to events coordinator Franxman for review and subsequent submission to the building inspector for action.  There is an estimate of $1,500.00 for the survey and mapping for the Union Community Center

PLANNING & ZONINGJim Longano - Planning and Zoning Union Representative

Mr. Longano was not in attendance but submitted his monthly report to the commission.  There is nothing this month that will affect the city of Union directly.

 

CITY EVENTS COORDINATOR:  Karen Franxman was not in attendance; her monthly report was presented by Commissioner Bob Kelly. The City of Union’s first “Movie Night” which was held on June 19th was very successful with approximately 500 people in attendance to see “Hotel for Dogs”.  Karen Franxman is working on the permit for the new Community Center.  Community theatre discussions are taking place with Ryle to gain access to the auditorium for future plays.

 

COMMISSIONER OF PUBLIC WORKS/UNION VISIONING COMMITTEE: Bob Kelly-Commissioner of Public Works; The Urban Forestry and right-of-way parcels on highway 42 have not been maintained by landscaping.  Mr. Kelly contacted A&A landscaping to ask them to maintain.  Urban Forestry is in the planning stages of a “kick-off” for the 2010 tree planting.  Pizzuti will be here on July 23rd.  They will make a presentation September 9th.  Water bags have been purchased (30-35) bags for the trees.  Hempsteade drive has a small center island that needs to be filled in.  Mr. Kelly contacted the Homeowners Association and will determine the long-term care of the island and long-term maintenance.  Complaint from homeowner Lisa Compo of 9069 Braxton Drive; there is a large mountain of dirt that has overgrown vegetation, the property is owned by Arlinghaus.  The property owner is requesting this land be maintained.  Mr. Greg Voss will look at the city’s ordinance and will do further research to determine the overgrowth of vegetation and who is ultimately responsible.  Mr. Paul Parmele addressed the commission with concerns that the speed bump on Burleigh Lane is too steep and too abrupt.  Mayor Kirby stated that he has not driven over the new speed hump, but will make an effort to do so, and explained it’s a balancing act between the two extremes and efforts are being made to get it right in order to serve the purpose of slowing traffic.  Commissioner Kelly stated that he has to slow down to 5 mph to clear the speed bump.  Mr. Barry Burke, city engineer, stated there is a difficulty in the construction placement of speed humps with asphalt.  While the overall specification complies with the ITE Standards, the contractor constructed this hump slightly higher and modifications near the approach ramps may be necessary.  He also stated that he did go over the speed hump at 20 mph with some concerns shared by the public may need further adjusting/feathering to lessen the severity for the uneven north side of the hump.  The intent would be to duplicate the speed humps on Hempsteade Drive.  Mr. Kelly stated the city needs to discuss ordering/storage of salt for winter.              

 

CITIZEN COMMENTS:    Mr. George Allen, 10021 Russwill Lane stated there are structural damages to his home as a result of the installation of a new sewer lateral installed in November 2008 using heavy equipment.  Attorney Voss obtained a structural engineer unbiased report from Roenker Engineering.  Mr. Barry Burke, city engineer, stated he has no contradictions to the report submitted which the Roncker Report stated that the city’s contractor was not responsible for his work causing cracks in the foundation.  Mr. Allen stated he is still working with Cincinnati Bell & Duke Energy to restore his telephone line and certain compensation regarding the loss of a 28 foot high tree.  Mayor Kirby stated there will be some value in having one additional professional structural opinion.  Mr. William Unkrat, 8770 Richmond Road, Union, Kentucky addressed the commission with the issue of twelve dead trees along the berm/entrance to Union Village and presented pictures.  His property is listed for sale and states he feels that the dead trees are deterring from the value of his home.  Attorney Voss stated that there is no city ordinance addressing this, but there is a possibility of amending the ordinance.  Commissioner Sayers has spoken with the owner of the property and asked that the trees be replaced and will continue to follow up on this issue.  Mr. Paul Parmele addressed the commission regarding the intersection of Burleigh and Hempsteade asking the commission to consider placing a yield sign for safety reasons.  Mayor Kirby asked City Engineer Barry Burke and others to observe the intersection and advise the commission.      

 

OLD BUSINESS:

Second reading of ORDINANCE  NO.  2009-006 - AN ORDINANCE ADOPTING AN ANNUAL BUDGET FOR THE FISCAL YEAR JULY 1, 2009 THROUGH JUNE 30, 2010 BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING FUNDS FOR THE OPERATION OF CITY GOVERNMENT FOR THE CITY OF UNION, KENTUCKY.  Commissioner Mefford made a motion to accept, Commissioner Sayers seconded.  Motion carried.

Second reading of ORDINANCE NO. 2009-008 – AN ORDINANCE REGULATING EXCESSIVE, UNNECESSARY OR UNUSUALLY LOUD NOISE WITHIN THE CITY OF UNION; PROHIBITING CERTAIN TYPES OF NOISES AS LOUD, DISTURBING, OR UNNECESSARY; PROVIDING EXEMPTIONS FOR CERTAIN TYPES OF NECESSARY NOISES; REQUIRING A PERMIT FOR INSTALLATION OF EMERGENCY WARNING DEVICES; AND PROVIDING FOR PENALTIES FOR VIOLATION OF THIS ORDIN­ANCE.  Commissioner Sayers made a motion to accept, Commissioner Kelly seconded.  Motion carried.

 

NEW BUSINESS:

First reading of ORDINANCE NO. 2009-007 – AN ORDINANCE ACCEPTING THE BID OF Rumpke of Union

Kentucky, Inc. AS THE LOWEST, BEST AND MOST RESPONSIBLE BID FOR THE EXCLUSIVE RIGHT, PRIVILEGE, AND FRANCHISE OF ENTERING IN AND UPON THE STREETS AND PUBLIC WAYS OF THE CITY OF UNION, KENTUCKY, FOR COLLECTING AND HAULING AWAY FROM HOMES, DWELLINGS AND OTHER PLACES WHERE NECESSARY, GARBAGE, TRASH AND REFUSE, AND GRANTING AN EXCLUSIVE FRANCHISE FOR SUCH PURPOSES.  Commissioner Kelly made a motion to accept, Commissioner Mefford seconded.  Motion carried.

 

A motion was made to change the City of Union regular business meeting from Monday, September 7th, 2009 to Wednesday, September 9, 2009 at 6:00 p.m. at the “new” firehouse.  Pizzuti will be in attendance to present the next phase of their report at 6:00 p.m.  The regular business meeting will take place at 7:00. Commissioner Sayers made a motion to accept, Commissioner Mefford seconded.  Motion carried.

 

Mayor Kirby stated that plans are ongoing to memorialize Warren and Madge Moore and that communication is ongoing with family members.  Efforts will be made to coordinate and advise the City of Union residents once a memorial date is established.

     

ANNOUNCEMENTS:

Next City Commission Meeting: Monday, August 3, 2009 @ 7:00 p.m.

 

At this point Attorney Voss stated the commission would go into Executive Session pursuant to KRS 61.810(a&b).  Mayor Kirby called for a motion to go into Executive Session.  A motion was made by Commissioner Kelly and seconded by Commissioner Sayers at 9:02 p.m.  Motion carried.

Mayor Kirby called for a motion to come back into regular session after the Executive Session the time being 9:24 p.m.  

 

ADJOURNMENT:

No further business came before the Commission. Commissioner Mefford moved to adjourn the meeting at 9:24 p.m. Commissioner  Sayers seconded the motion. Motion carried.
