MINUTES
CALL TO ORDER
Mayor Don Kirby called the regular business meeting of The Union City Commission to order in the Union City Building at 7:30 p.m., Monday, October 13, 2003.
Present: Mayor Kirby, Commissioners: Jonathan Jennings, Warren Moore and Wayne McClellan. Greg D. Voss (City Attorney), Kathy Porter (City Clerk/Treasurer), and Jim Curry (City Engineer).
Absent: Commissioner Gary McCormick.
Visitors: Pinky Morgan, David Hils, Mike Trout, Allison Reese, Ben Studer, Mike Murry, Andy Rosen and Andrew Mustacchio.
MINUTES:
After reviewing the previous monthly meeting minutes presented, Mayor Kirby asked for any comments or corrections. Mr. Moore moved to dispense with the reading of the minutes of September 9, 2003 and accept as presented. Mr. McClellan seconded the motion. Motion carried.
TREASURER’S REPORT:
Mayor Kirby read the Treasurer’s Report for the month of September 2003. A motion was made by Mr. McClellan to accept the Treasurer’s Report. Seconded by Mr. Jennings and motion carried.
BILLS FOR PAYMENT:
The City Clerk brought to attention the Boone County Water bill received today was $584.29. This bill includes last month's amount which was $363.62. Mr. McClellan had inspected and tested the water meter with the water company and found no definite cause for the usage and the bill should be paid. Mayor Kirby asked for any other questions. No other information, Mr. Jennings moved to pay the bills with a second to the motion by Mr. Moore. Motion carried.
CORRESPONDENCE:
A letter of interest in filling the vacancy on the Union Board of Adjustment was received from David Hils. Mayor Kirby recognized Mr. Hils and asked him to speak to the Commission. Mr. Hils owns property in Union and built his home on Big Bone Road in 1987. He expressed his interest in helping the City in managing future growth.

Mayor Kirby had received complaints that kids had been riding ATVs on a field located off of Mt. Zion Road property owned by Jim Collett. A note was received from Mr. Albers verifying the noise. Mr. Collett had spoken about the problem and had made it clear that he didn't want the individuals trespassing on his property and if anyone observes such action to call the Sheriff's Department.
CITY ENGINEER REPORT:
City Engineer Jim Curry reported on Abbington Drive. He had researched the plat and had contacted several of the residents and examined the drainage issue between 1108 through 1136. Originally the lots were constructed to drain to the rear with a drainage swale along the rear lot line to carry the water to a catch basin and storm sewer located behind 1108. All the houses have basement sump pumps which discharge to the surface and water is then conveyed to the rear swale through a side yard swale. Several of the concerned residents were present and presented their problems. Mr. Andrew Mustocchio agreed with the Engineer's report and asked if this is a private case of action between the developer and owner. Both Erpenbeck and Ryland are involved. The resident at 1108 has a safety concern because after she moved in the developer uncovered the catch basin and made a swale by approximately a 4 ft. deep ditch through her property, her toddler could get caught in the type of catch basin which has a top grate with rectangular opening on the sides, which the child could easily get hurt. The residents are very concerned over the saturated condition of their yards and especially during rains, the water overflows the swale and spreads out to cover most of the back yards. Attempts to get help from the County proved fruitless, Paul Buchanan had been contacted and the answer was they didn't get involved in rebuilding swales. According to the Boone County Subdivision Regulations this development is substantially in compliance requiring the developer to handle storm water with swales at the rear lot lines with side yard swales to direct a property's storm water to this rear yard swale. Also, the catch basin installation matches the one required. Mayor Kirby felt this issue is one that is a safety factor and he would get a copy of the restrictions and would make some phone calls to the developers to discuss the situation. Mayor Kirby also asked for the concerned persons to give him some of their information after the meeting that would help him to present his case. Mr. Mustocchio will serve as the contact person between the City and the residents.
After checking the Braxton Drive stop sign situation near Kroger and the Library, there is stop bars painted on the street at the first Library/Kroger entrance from US 42. Two stop signs at the second Library/Kroger entrance but no stop bars. Two stop bars painted on Braxton at the intersection with Sherman, but no stop signs are installed. The two stop signs from the second Library/Kroger entrance should be moved to the first location with the existing stop bars and install two new stop signs at Sherman. All of the existing stop bars should be repainted. Mr. McClellan had some questions regarding the stop signs. He felt that the signs at Braxton and Richmond are fine except for striping, which is barely visible.

Mayor Kirby suggests that the baked on striping should be applied for better visibility. Ms. Morgan questioned why there was not a sidewalk in that same section down to Kroger, Mr. Curry will investigate this to find out if there should be a sidewalk located there. The Braxton storm sewer project is complete. Ms. Morgan expressed that she was concerned about the type basin that was installed in her neighbor's yard being flat and hers was a funnel type and feels this is not taking the water away from her yard. Mayor Kirby instructed Mr. Curry to inspect the situation and determine if the drainage was installed properly. Regarding the Sycamore Drive sewer installation the contractor is back to work again and the rest of this project should be complete by the end of the month. Mr. McClellan asked about the repair of the road and Mr. Curry responded that according to the contract where the sewer was installed in the middle of the road that entire section will be repaved when finished.
PLANNING & ZONING:
Mr. Randy Barlow not present therefore there was no report.
OLD BUSINESS:
Mr. McClellan reported that the water
meter at Lassing Green entrance proved to be accurate and thinks that the water
is being used where it was not being used before and would recommend that a key
lock be installed on the faucet.
Second reading of ORDINANCE NO. 2003-007 - AN ORDINANCE LEVYING AND FIXING THE TAX RATES OF THE CITY OF UNION, KENTUCKY, FOR THE FISCAL YEAR OF 2003-2004, LEVYING SAID TAX UPON REAL AND TANGIBLE PROPERTY, FIXING THE DATE OF PAYMENT, DISCOUNT PAYMENT, DELINQUENCY AND INTEREST CHARGES, FIXING THE PURPOSE THEREFORE, AND SETTING FORTH THE PROCEDURE FOR COLLECTION OF TAXES. Mayor Kirby had read the Ordinance in full upon first reading. Mr. Moore moved to accept second reading. Mr. Jennings seconded the motion. Motion carried.
NEW BUSINESS:
A resident from the audience brought up the sewer bills that she received. It was determined that the water had come from City of Florence and Sanitation District, regarding the locations served.
Ms. Morgan would like to donate a Purple or a Copper Beech Tree and would like to know if there is a Park location where they could be planted. Mayor Kirby will see what the City can do and where.
A citizen in the audience asked if there had been any thoughts on the City being wireless on the Internet. In the past there had been some consideration and at the time it was very expensive.

Mayor Kirby said that the City will stay concerned and will be a possibility in the future.
Ms. Morgan would like for the City to think about a Resolution to reject the Patriots Act. Mayor explained at this time the City is non partisan and feels the City should not take a stand.
Gunpowder Green Estates street id signs are installed and painting is complete.
Mayor Kirby mentioned that the Computer in the Mayor’s office is outdated and he would like to get rid of it. After discussion, Mayor Kirby will reformat the hard drive and dispose of the obsolete computer.
Mr. Moore made a verbal Resolution for the City of Union Trick-or-Treat time to be Friday, October 31st from 6:00p.m. to 8:00p.m. Mr. Jennings seconded the motion. Motion carried.
ADJOURNMENT
No further business came before the Commission; Mr. Moore moved to adjourn the meeting at 8:27p.m. Mr. Jennings seconded the motion. Motion carried.
