MINUTES
Mayor Don Kirby called the Public Hearing to order
at 7:30 p.m. with the following Commission members present: Mr. Jonathan Jennings, Mr. Gary McCormick
and Mr. Warren Moore. Absent was Mr.
Wayne McClellan. Also present were City Clerk Kathy Porter and Attorney Greg
Voss. After explanation of compensation
rates and designated projects that would need appropriated funding, it was
agreeable to proceed with the rate of $2.13 per $1000 Assessed Valuation on all
Real Property and $2.52 per $1000 Assessed Valuation on all Tangible Personal
Property. Mayor Kirby asked if anyone
in the audience had any comments and there were none. Mr. Moore moved to
proceed with setting the year 2003 property tax rate and motion seconded by Mr.
McCormick. Motion passed and Public
Hearing adjourned at 7:32 p.m. and entered into the regular monthly business
meeting.
Mayor Don Kirby called the Regular Business Meeting of the Union City Commission to order. The following members of the Commission were present: Mr. Jonathan Jennings, Mr. Gary McCormick and Mr. Warren Moore. Absent: Mr. Wayne McClellan. Also present were: City Clerk Kathy Porter, City Attorney Greg Voss and City Engineer Jim Curry. Residents in attendance were William S. Yauch, Estelle Morgan, Allyson Reese, James Mall, Andrew Rosen, Andrew & Brenda Mustacchio, Wes Bittlinger, Harden Family, Rich Haney and Greg Lloyd.
Mayor Kirby asked for a motion to accept the August
11, 2003 meeting minutes as presented.
Mr. Jennings so moved with a second by Mr. Moore. Motion carried.
Mayor Kirby presented the Treasurer’s Report as of
August 31, 2003. Mr. McCormick moved to
accept the Treasurer’s Report. Motion
seconded by Mr. Jennings. Motion
carried.
Mayor Kirby asked the City Clerk to mention that
Boone County Water Dept. bill that was listed on the bills for payment tonight
from the Boone County Water Dept. in the amount of $363.63 is for the
irrigation system at the Lassing Green Entrance area. Mr. Moore made a motion
to pay the bills as presented with the exception of the Boone County Water Bill
that is in the amount of $363.63 until we can investigate further Mr. Jennings
seconded the motion. Motion carried.
Mr. Donald W. Harden tendered his written
resignation as board member of the City of Union Board of Adjustments to be
effective immediately. Letter was dated
September 3, 2003.
A letter was received from Fifth Third Bank – dated
8/14/03 serves as Trustee of the Thelma R. Feldhaus Trust. Mrs. Feldhaus died
on June 8, 2003. Mrs. Feldhaus left a bequest of 5% of the residue of her trust
to Union Rice Cemetery.
Mayor
Kirby called on Mrs. Peggy Littrell – Hempsteade Subdivision regarding noise as
listed on tonight’s Agenda. Mrs. Littrell was not present.
Mayor
Kirby recognized Mr. Andrew Mustacchio of 1116 Abbington Drive concerning his
complaint of a drainage problem. Ryland
Homes had illegally moved a 10ft surface drainage easement which should have
been centered on property line and moved it approximately 15ft. into his yard
causing severe flooding and pools of standing water. Mr. Mustacchio had checked with Kevin Wall at Boone County
Planning & Zoning and according to him, there was no drainage
easement. Ryland Homes notes a 10ft.
drainage easement. As a result the
drainage from all the down spouts is forced into the residents’ back yards on
Abbington Drive, thus causing damage to properties with standing water. Ryland Homes, Boone County Public Works and
Boone County Building Department have been contacted without a definite
response in addressing this problem. He
is waiting for a response from Boone County Sanitation Environmental Services.
The drainage affects approximately 10 property owners. Mayor Kirby instructed City Engineer Jim
Curry to do an inspection of the problem tomorrow morning. After hearing from Alice Reece as to other
concerns regarding her neighbors’ properties, Mayor Kirby assured that the city
would start this process of support to determine whether the condition presents
safety, health and property values concerns.
Ms. Estelle Morgan questioned
the legal aspects and responsibility of contractors. The City can only do so much such as specifications and
inspections. Attorney Greg Voss will check the legal issues although in some
cases, this involves private actions.
CITY ENGINEER REPORT:
City Engineer Jim Curry, P.E. reported on the
following:
1.
Indian
Hill Drive Project – met with Michels Construction on Friday and they submitted
their bonds, insurance and everything is in order for work to start. Work
should begin this week.
2.
Checked
entrance to Hempsteade Drive per complaint.
There are no potholes, possibly the slotted drains are a concern; this
is probably causing buckling in the street. Will keep checking.
3.
No
work has been done recently on the Sycamore sewer project. Had checked with the
Sanitation Department, nothing definite, possibly the contractor could be
having some financial problems.
Mr. Greg Lloyd, contact person for the Braxton Storm
Sewer project reported that his wife in his absence conferred with Mr. Jim Winstrop
and conveyed to him that the project funds were being held in escrow. Attorney Voss will contact Mr. Winstrop to
explain how funds are to be handled.
Scheben prefers to hold their portion of the payment until the job is
completed. Mayor Kirby informed Ms.
Morgan that funds from her builder were not as favorable. The builder feels he is not responsible as
the time he built the house, the other builders and contractor left him no
choice, but to grade as the project was started.
Randy
Barlow, P&Z had no report at this time.
None presented.
Mayor Kirby read in its entirety on First
reading of ORDINANCE NO. 2003-007 – AN ORDINANCE LEVYING AND FIXING THE
TAX RATES OF THE CITY OF UNION, KENTUCKY, FOR THE FISCAL YEAR OF 2003-2004,
LEVYING SAID TAX UPON REAL, AND TANGIBLE PROPERTY; FIXING THE DATE OF PAYMENT,
DISCOUNT PAYMENT, DELINQUENCY AND INTEREST CHARGES; FIXING THE PUROSE
THEREFORE; AND SETTING FORTH THE PROCEDURE FOR COLLECTION OF TAXES. Motion to accept on first reading by Mr.
McCormick and seconded by Mr. Jennings.
Vote was unanimous.
Mayor Kirby brought to attention, the number of complaints that had been received on the condition of Whispering Trail due to construction. Executive Director, Kevin Costello of Planning and Zoning had contacted the State and asked them to advise the contractor, that clean up of the streets are to be done on a daily basis. A continuous check will be done to try and get the area cleaned up with the help of P&Z.
The City Clerk brought up that Mr. McClellan had asked her to get some prices on striping the roadways on Braxton Drive and Richmond Road. Pricing on Richmond Road will be $425.00 with 6 stop bars and Braxton Drive will be $525.00 with 5 stop bars. After discussion, Engineer Jim Curry will give a report and recommendation where stop signs for stop bars are needed.
Mayor Kirby
called for a motion to go into Executive Session pursuant to K.R.S. 61.810 (1)
(b) to discuss the possible acquisition/sale of real property. Mr. Moore so
moved, with second from Mr. McCormick and unanimous approval of the Commission,
the time being 8:30p.m.

motion to come back into session after the Executive Session pursuant to K.R.S.
61.810 (1) (b) to discuss the possible acquisition of sale/real property. Mr.
Moore so moved, with second from Mr. Jennings and unanimous approval of the
Commission, time being 8:59p.m.
There
being no further business to come before the Commission, Mayor Kirby called for
a motion to adjourn. Mr. Moore moved to adjourn the regular business meeting
with second by Mr. Jennings and unanimous approval of the Commission, the time
being 8:59p.m.
