CITY COMMISSION MEETING

MINUTES

August 12, 2002

 

 

CALL TO ORDER

Mayor Warren S. Moore called the Regular Meeting of the Union City Commission to order at 7:30 p.m. on Monday, August 12, 2002 in the Union City Auditorium.

Commissioners in attendance: Mr. Kirby, Mr. McClellan, Mr. McCormick and Mr. Jennings.

Also present were City Clerk Kathy Porter, City Engineer Representative Jim Curry of Estes Engineering Inc. Former City Engineer Willard Rusk, and Attorney Greg D. Voss in the absence of City Attorney David W. Martin.

 

APPROVAL OF MINUTES

Mr. McClellan moved to approve the Regular Business Meeting Minutes of July 8, 2002, seconded by Mr. Kirby and motion carried unanimously.

 

TREASURER’S REPORT

Mayor Moore explained that a Treasurer’s Report is not available at this time as the hard drive crashed and the computer is at Gateway being serviced and as a result was not able to produce the Treasurer’s Report for the meeting tonight. Motion made by Mr. Kirby to dispense with the reading of the Treasurer’s Report and seconded by Mr. McClellan.

 

BILLS FOR PAYMENT

Mayor Moore presented the hand typed list of bills for payment for review. Motion to pay the bills by Mr. McCormick and seconded by Mr. Kirby. Motion carried unanimously.

 

CORRESPONDENCE

Mayor Moore commented that a vacancy remains on the Board of Adjustments and the city has advertised for a volunteer. Mr. Don Harden of 1700 Sherman Court was the only one that has responded and interested in serving on this Board. Mr. Harden was present in the audience tonight and Mayor Moore administered the Oath of Office to Mr. Harden. 

Mayor Moore read Resolution No. 02-006 – A Resolution Appointing Donald W. Harden to the City of Union Board of Adjustment. Motion to accept by Mr. Kirby and seconded by Mr. McCormick. Motion carried unanimously.

 

ANNOUNCEMENTS:

Mayor Moore announced that the Board of Adjustment Public Hearing location has been changed to the auditorium of Ryle High School @ 7:30 p.m. on Monday, August 19th, 2002.

Commissioner Jonathan Jennings arrived at this time.

 

CITY ENGINEER REPORT

At this time Mr. Willard Rusk, P.E., reported the following:

 

1.     The sidewalk is completed at the entrance to Farmview Drive.

2.     The Cable Contracting Company has completed all their Encroachment Permit work on Churchill Drive.

3.     The Coughlin’s are satisfied with the work that has been done there. Drees came in and brought material, seed and straw and wanted Mr. Rusk there to see that it got the right grade on it. The work is completed. 

4.      Talked with the Mayor earlier this month regarding emergency ordinance on noise of concrete trucks at the apartments in Florence next to Union Village. Most of the work that has bothered the residents is over with. Mr. Rusk suggested to David Estes that this might be a good location for a speed plateau right there as you go into Florence. The road in the apartment area is a private road and connects to a public road (Braxton) in the City of Union and would be a good location for a speed plateau to discourage Florence residents from using this as a short cut to the Kroger and Library complex.

5.      Have been discussing with David Estes some of the projects that have been going on the last few years, including Whispering Trails and Indian Hill Drive.

6.      Gave Michels the approval to reseal on Hempsteade Drive. Mr. McClellan asked about the blacktopping on Clarkston Lane. No definite answer as supposedly this had been done by the County.

 

Mr. Jim Curry of David Estes Engineering, Inc. reported on the following:

1.      Had received a copy of the Deed on Lot No. 454-A in Hempsteade Subdivision Section 11, Blocks C and D specifying that the City is responsible for maintaining the detention basin.

2.      A copy of the Kroger 424A Fueling Center drawings had been received from Keith Holtz of QK4 Architects. Per a telephone conversation with Mr. Holtz, they are going to submit the required encroachment permit forms and bond to the City. Concerns of traffic patterns within the development were discussed. Mr. Holtz indicated he would make Kroger aware and the effects it would have on their operations.

3.      David Estes had attended the Boone County GIS Advisory Board meeting on July 31st. The GIS staff will install the City’s mapping system and will provide the training for its use, it is suggested that the City Clerk attend to begin learning the systems capabilities.

4.      Mr. Estes and Willard Rusk toured several sections of the City where Mr. Rusk had been working. During the inspection, the hole at 10186 Hempsteade Drive was inspected and it appears as though a storm manhole is leaking and causing infiltration of soil-laden runoff. The more it rains the bigger the hole will get. Mr. Rusk believes that the problem has something to do with Cinergy laying additional underground electrical duct banks in the vicinity. Kenny Crooker of the Boone County Public Works has looked at this problem and notes are being compared to get the problem fixed. The center island of the intersection of Hempsteade and Cedarwood was looked at. The curb had been broken and needs replaced. Drees requested the City make the repairs. A recommendation that the City contract with a small contractor to make the repair.

5.      Plans are to attend the City’s Board of Adjustment meeting at Ryle High School on August 19, 2002. On behalf of the City concerns will be voiced on traffic and the need for more information regarding the request to construct an Islamic church and school at 1290 Mt. Zion Road.

6.      The US 42 project bids were opened on July 26, 2002. According to Sam Beverage, Chief District Engineer. The award has not been made due to proper permits had not been obtained. Will follow up and get information when it is available.

David Estes Engineering has enjoyed their first month as our City Engineer and hope to catch up on all the issues that face the City as they relate to Public Works.

Mayor Moore asked Mr. Curry if he knew where the water lines were located coming down US 42. He will get that information.

Mayor Moore mentioned the piece of correspondence in which everyone has a carbon copy concerning the letter that David Geohegan of the Boone County Planning and Zoning sent to Samuel Beverage, Chief District Engineer regarding the five-lane construction of Mt. Zion Road. The letter mentioned that P & Z supports that construction, however there is no knowledge that support is valid with residents on Mt. Zion Road. Had talked with Richard Rutledge and he had said they were leaning toward three lanes after reworking and using Hopeful Road as an example due to its traffic use. It would probably be good to let P & Z know that the City does not support the five lanes and feel they should support our views.  Also, regarding the subject of an overpass over old US 42, a lot of time has been spent on the Union Town Plan and an overpass is not needed. The need is still the intersection at that point. David Geohegan will be notified as the need to readdress these items.

 

PLANNING & ZONING

No report.

 

OLD BUSINESS

Second reading of ORDINANCE NO.: 2002-004: An Ordinance relating to the adoption and approval of zoning regulations, including text and zoning map, as part of the update review and amendment of the current Boone County Zoning regulations applicable to the City of Union, Kentucky.  Motion to accept second reading by Mr. Jennings and seconded by Mr. McCormick. Motion carried.

Second reading of ORDINANCE NO.: 2002-005: An Ordinance enacting and adopting a supplement to the Code of Ordinances of the City of Union Kentucky.  Mr. Kirby moved to accept second reading and seconded by Mr. Jennings.  Motion carried.

 

NEW BUSINESS

Discussion of a new property tax computer program, Mayor Moore mentioned that the City Clerk had checked with City of Walton regarding the program that they utilize with Capital Software, Inc. and is considering the possibility of obtaining the new property tax software for the City of Union. The Commission was in agreement that a new program was needed.

Mayor Moore informed the Commission that tomorrow is the last day to file for the November election.

Mr. Don Kirby had attended a meeting with Boone County Judge Executive Gary Moore, County Administrator Jim Parsons, State Representative Paul Marcotte and County Commissioner Charlie Kenner to discuss what steps could be taken to stop or slow down the continuous annexations, promises, etc. surrounding the City of Union. All seemed to be in agreement and plans are being made to schedule another meeting with the Sanitation District in approximately two weeks. Mayor Moore requested that David Estes or Jim Curry be asked to attend that meeting.

No further business, Mr. McClellan moved to adjourn meeting at 8:05pm.  Seconded by Mr. Kirby.  Motion carried unanimously.
