MINUTES

May 13, 2002

 

Public Hearing for Municipal Road Fund & Local Government Economic Assistance Funds   Mayor Warren S. Moore called the public hearing to order at 7:38 p.m. The purpose of the public hearing was to hear citizen’s comments regarding the possible uses of the Municipal Road Aid and Local Government Economic Assistance Program Funds for the upcoming fiscal year. Mayor Moore recognized Mr. Dennis Shelters, 10151 Hempsteade Drive, Union, Kentucky. Mr. Shelters spoke regarding a drainage problem on Hempsteade Drive located in front of the Butler residence where the large pipe goes under the road. This particular spot during hard rains, cars stall out for the water being so high. Mayor Moore commented that this information would be passed onto City Engineer Willard Rusk whom is absent tonight.  Mr. Rusk would be able to tell us what needs to be done about this. There being no further comments from the public, Mr. McClellan made a motion to close this Public Hearing and the motion was seconded by Mr. Kirby at 7:40 PM. Motion carried.

 

CALL TO ORDER:

Mayor Moore called the regular business meeting of the Union City Commission to order at 7:40 p.m. in the Auditorium of the Union City Building. Commissioners in attendance were: Mr. Don Kirby, Mr. Wayne McClellan and Mr. Gary McCormick. Also, in attendance were Attorney Greg D. Voss in the absence of City Attorney David W. Martin and City Clerk Kathy Porter.

 

Absent were: City Commissioner Jonathan Jennings and City Engineer Willard H. Rusk.

 

APPROVAL OF MINUTES:

Mr. Kirby made a motion to accept the Regular Business Meeting Minutes of April 8, 2002 as presented and seconded by Mr. McClellan.  Motion carried.

 

TREASURER’ REPORT:

Treasurer’s Report as of April 30, 2002 was read and presented for acceptance by Mayor Moore. Motion made by Mr. McClellan to accept as presented and seconded by Mr. Kirby. Motion carried.

 

BILLS FOR PAYMENT:

Mayor Moore presented the bills for payment for review. Motion to pay the bills as presented was made by Mr. Kirby and seconded by Mr. McClellan. Motion carried.

 

CORRESPONDENCE:

Mayor Moore noted that he received correspondence from the Boone County Planning Commission informing us that that the Union Board of Adjustment member term of Carl Caudill will expire on June 30, 2002. Anyone interested in serving on the Board of Adjustment is asked to contact City Clerk Kathy Porter.

 

Mayor Moore noted that he received correspondence from Burlington Publishing Systems that outlines the proposed costs of supplementing the City’s Code of Ordinances that will bring our current Code of Ordinances up-to-date, as required by law. The current code of ordinances that we have didn’t cost anything as we obtained it with a state grant and commented that it is not user friendly. The project will consist of: Edit and insert into the code all ordinances since 1997 of a general and permanent nature. Compare with state and federal law to insure consistency of laws and to remain up-to-date, including a legal review. Update summary of ordinances to show description, and include a summary of resolutions. Update the Index to be more user friendly. Delete unwanted sections and/or chapters from existing Code Book as not needed by the city. Mayor Moore gave City Clerk Kathy Porter the approval to accept the proposal from Burlington Publishing Systems not to exceed $1,331.00.

 

Mayor Moore reported that City Engineer Willard Rusk sent a letter to Boone County Planning Commission concerning the new Wendy’s Restaurant basically saying that the City of Union will not approve the site plan without the trench drain and the ditch inlet at the Northeast corner of the Wendy’s site. The City does not want similar concerns on the Wendy’s site that surfaced with the construction of the Skyline project.

 

Received a letter from Cinergy/ULH&P that Arbor Springs @ Plantation Pointe Subdivision Phase II, Part C & D will install twelve (12) street lights on fiberglass poles which will increase the monthly street light bill by $80.64 plus the monthly fuel adjustment charge per month.

 

Mayor Moore read a letter received from Mayor Tom Holocher City of Fort Mitchell regarding the Kentucky League of Cities that will be held at the Northern Kentucky Convention Center in Covington on October 2-6. The hosting city has the responsibility to plan and pay for all expenses for the Board/Delegate Opening and Closing Reception. Provide security and EMT personnel. Plan all the Spouse Activities. In the past, when this convention was held in Northern Kentucky, the cities of Northern Kentucky contributed and they recommended a pay scale based on population: 0-5,000 contribute $750.00. 5,000-10,000 contribute $1,000.00 etc. Mayor Moore said that this is not too much to ask and we do gain from the Kentucky League of Cities, this contribution amount is small enough to go ahead and contribute that no action from the Commission is needed unless anyone has objection. There were no objections.

 

Mayor Moore reported that two complaints were received concerning sidewalk conditions on Aspen Place in the Lassing Green Subdivision and the City Clerk informed the Mayor that City Engineer Willard Rusk is working on both of these issues.

 

Mayor Moore mentioned that the Waste Collection Bid opening will be under New Business tonight and reported that as of April 29, 2002 there were 1087 residential units in the city.

 

Mayor Moore read a summary of a letter he received from the Northern Kentucky Municipal Clerks Association regarding a request for nominations for the year 2002 Outstanding City Clerk Award. Each year at their Annual Meeting in August, the Northern Kentucky Area Development District (NKADD) recognizes an Outstanding City Clerk as part of their Public Sector Contributor awards. As in past years the Northern Kentucky Municipal Clerks Association has been contacted to select the person to receive this award. A nomination form has been provided for review and submission. Nominations may be submitted by any Mayor, City Clerk, City Clerk-Administrator, City Clerk-Treasurer, Deputy City Clerk or Assistant City Clerk within the NKADD. Nomination forms are due to NKADD by May 31, 2002. Mayor Moore commented that he intends to nominate City Clerk/Treasurer Kathy Porter.

 

CITIZENS WISHING TO BE HEARD:

Mr. Dennis Shelters of 10151 Hempsteade Drive was present tonight to discuss the drainage easement located behind his property and goes under Hempsteade Drive. Mr. Shelters is concerned that there is a safety issue within this wide area of the fencing. The fencing enclosure is continuing in disrepair and personally takes his time to clean it out, and tries to keep it clean. Every time there is a hard rainstorm the debris is building up in the drainage easement. He commented that Mr. Rusk is fully aware of the situation, as he had it repaired once last year. Mayor Moore commented that this is a viable issue to look at and when Mr. Rusk is available again he will inspect those areas of concern. Mayor Moore commented that Mr. Rusk is actually trying to finally retire and will be available to work with as well as David Estes Engineering who is taking over a majority of this type of work.  Mayor Moore commented that the fence was put there for safety concerns and should not become a visual hazard as well as a safety hazard. Mr. Shelters commented that the gate is unlocked and is open and has collapsed.

 

CITY ENGINEER REPORT

No report. Mr. Willard H. Rusk P.E. absent

 

PLANNING & ZONING REPORT

Representative Randy Barlow reported on the following:

 

  1. Reported that there is a new K.R.S. applied to Zoning Enforcement Code Enforcement Board and thinks this applies to all class cities and what it allows us to do as a city would be to appoint three, five or seven people on an enforcement board that can deal with enforcement issues on a local issue and asses penalties and fines. This may be something of interest in the future as we take on more development.

                 

  1. Mr. Barlow reported that he is serving as Chairman on the Enforcement Committee on Planning and Zoning and will be having a meeting this Wednesday. He mentioned that there are three inspectors and they average about 100 inspections or issues a month and for the two years that he has served on the Planning and Zoning he has not noticed any violations from the City of Union area and wasn’t sure if concerns or issues were being taken care of and if they were not to let him know and he could bring up any issues or concerns we may have at the meeting or if there are any in the future to let him know. Mayor Moore commented that the enforcement officer has been inspecting the area in the past and the majority of the issues we get here at the city building are property owners in violation of not cutting their grass and we usually handled that type of issue. Mr. Barlow mentioned that he would check with the inspectors and find out if they are inspecting the City of Union while driving through the county.

 

OLD BUSINESS:

Attorney Voss reported on the response he received from Planning and Zoning regarding the sidewalk issue on the lot in the Lassing Green Subdivision. The only time Planning and Zoning will do anything about the sidewalks is when there’s new construction. This is a flag lot and the person buys the lot in front of them and is not putting a sidewalk in. It’s a developable lot, there is no construction on it and the reason they don’t require sidewalks is if you are going to build something than the sidewalk would be tore up during the construction process and that’s the reason we won’t get any enforcement. Attorney Voss will check and see if the lots were purchased at the same time.

 

NEW BUSINESS:

Sealed bids for Waste Collection Service for the Fiscal Year July 1, 2002 through June 30, 2003 were opened. Three Waste Collection Companies presented bids on the bid sheet as required from the City of Union, Kentucky in the Bid Specifications provided to each company dated May 2002.

 

Mayor Moore opened and read the following company bid amounts:

 

Ø      Bavarian Trucking………………………$ 9.00 cost per unit/per month

Ø      CSI Waste Services……………………..$ 8.00 cost per unit/per month

Ø      Rumpke of Kentucky, Inc……………….$ 8.50 cost per unit/per month

 

All bids were based on the City of Union Specifications. Representatives from Bavarian, CSI and Rumpke Waste Collection Companies were present to answer questions. Recycling is regarded as an option between the Waste Collection Company and the property owner.

 

Mr. McCormick made a motion to enter into an agreement with CSI Waste Services to collect garbage for the cost per unit at the rate of $8.00 per unit per month. Second by Mr. McClellan and motion passed unanimously.

 

Mayor Moore presented and reviewed the Bookkeeper’s Budget Comparison with the Commission and discussed the different categories that need amended. Mayor Moore will take the existing budget and make the corrections and that will become exhibit “A”. After discussion and review of the changes Mayor Moore advised that he would make the adjustments on the existing budget to reflect the changes.

 

Mayor Moore presented the following Ordinances for first reading.

 

First reading of ORDINANCE NO.  02 - 001    An Ordinance Amending The City Of Union, Kentucky Annual Budget For The Fiscal Year July 1, 2001 Through June 30, 2002 By Estimating Revenues And Resources And Appropriating Funds For The Operation Of City Government.  Motion to accept first reading by Mr. McCormick and seconded by Mr. McClellan.  Motion carried unanimously. Second reading of Ordinance No. 02-001 will be at the next regular business meeting.

 

Mayor Moore mentioned that we should be having first reading this month for the new fiscal year 2002/2003 budget and second reading at the June meeting explaining that he will prepare the budget and have first reading at next month regular business meeting. The 2001/2002 Budget remains in force as if readopted. 

 

First reading of ORDINANCE NO.  02- 002 - An Ordinance Accepting The Bid of CSI Waste Collection Services To Provide Waste Collection Service In The City Of Union, Kentucky Commencing July 1, 2002 Through June 30, 2003 And Authorizes The Mayor To Enter Into A Contract With CSI Waste Services. Mr. McCormick so moved to accept the bid amount from CSI with a second from Mr. McClellan.  Motion passed unanimously.

 

Mr. McClellan mentioned that he would like a follow-up on the Sewer Extension Investigation. Mayor Moore read a letter that Willard Rusk, City Engineer received from James R. Curry, PE of David Estes Engineering, Inc. in regards to installing sewers in two areas of Union. One along Mt. Zion Road from an existing sewer at the intersection of Gunpowder Road and Mt. Zion Road running east Mt. Zion Road to I-75. This proposed sewer would generally follow the right of way of Mt. Zion Road for a distance of 4500 feet and would serve all properties fronting Mt. Zion Road between Gunpowder Road and I-75. The estimated cost of this sewer is $270,000. The second proposed sewer from the City Building on Mt. Zion Road to an existing sewer North of Union is more problematic. The proposed sewer would have to follow Mt. Zion Road to US 42, then follow Fowler Fork Creek north to an existing sewer in the South Fork Creek. While it is possible to build this sewer in South Fork Creek and would not likely permit a major trunk sewer to be added to the system at this time. Suggested that the City contact the Sanitation District to find out the status of the District’s expansion plans to relieve capacity problems in Boone County, and to see if the District would extend the trunk sewer up Fowler Creek to Union. The City of Union is poised for tremendous growth in the future; however, this growth could be hindered if the trunk sewer system is not extended up Fowler Creek. Mr. McClellan would like to contact David Estes Engineering and get a meeting set up with the Sanitation District.

 

No further new business, Mr. McClellan moved to adjourn the meeting at 8:30pm. Mr. Kirby seconded the motion. Motion passed unanimously.
