COMMISSION MEETING MINUTES

OCTOBER 12, 1998

 

Mayor Warren Moore called the Public Hearing to order at 7:25 p.m. The purpose of the public hearing was to hear written and oral comments or suggestions regarding the use of Municipal Road Aid Funds and Coal and Mineral Severance Funds. Mayor Moore noted that currently there is $27,688.62 in the Municipal Road Fund and $11,726.75 in the Coal and Mineral Fund. There were no written or oral comments received. Mayor Moore asked for a motion to use the Municipal Road Aid Fund and Coal and Mineral Fund totaling $39,415.37 on the Sycamore Drive project. Commissioner E. Johnson so moved with a second from Commissioner J. Johnson and the motion carried unanimously. Meeting closed at 7:30 p.m.

CALL TO ORDER:

Mayor Warren Moore called the meeting to order at 7:30 p.m. Present were Commissioners Hunt, E. Johnson, J. Johnson and Wayne McClellan. City Clerk Kathy Porter, and City Engineer Willard Rusk. Absent City Attorney David W. Martin. Attorney Greg D. Voss was present in absence of City Attorney David W. Martin. The following citizens were in attendance: Ms. Frances Barlow, Ms. Ada Horton, Ms. June Wagner and Mr. Bob Blair.

MINUTES:
The minutes of the regular business meeting of September 15, 1998 were reviewed. Commissioner McClellan made a motion to accept the minutes of 09/15/98 as printed. Commissioner J. Johnson seconded and the motion carried unanimously.

TREASURER’S REPORT:

Mayor Moore read the summary of the Treasurer’s report. After presentation, Mayor Moore called for a motion to approve the report as presented. Motion was made by Commissioner J. Johnson, seconded by Commissioner Hunt and the motion carried unanimously.

BILLS FOR PAYMENT:

The bills for payment were reviewed. Commissioner Hunt made a motion to pay bills as presented. Commissioner J. Johnson seconded and the motion carried unanimously.

DEPARTMENTAL REPORTS:

Commissioner Johnson had no report.

CITY ENGINEER REPORT:

City Engineer Willard Rusk provided the Commission with updates on the following projects:

  1. Lassing Green - There is a lot of junk and debris on vacant lots and in particular lake lots. Mayor Moore stated that a letter be sent out to developers to maintain their development sites by prompt clean up of junk & debris, which would probably enhance their sales and provide a better atmosphere for the community.

  2. Churchill Drive - Repairs on the street should be started this week.

  3. Ivy Pond – Golden Pond intersection repairs should begin soon. This work will not be charged to the City.

  4. Hempsteade Subdivision - Noted that a few streets need maintenance. There are three or four places in Hempsteade Subdivision where trucks have caused the asphalt to break up badly and have received a couple of calls. If we find additional money that could be spent on construction street repairs then we should do it soon. There is a hole right at the storm sewer that is about 6 inches in diameter and goes down about five to six inches that is only getting worse and will try to get someone in there to fix it. Also, an area on Hempsteade Drive behind the curb has a sinkhole and the concrete has been placed on the pipe and needs repaired. Will contact Public Works to see if they can repair it.

  5. Union Rice Cemetery – Obtained two estimates for paving the cemetery road -- one from Len Riegler Blacktop Inc. in the amount of $4,680.00 and the one from Paul Michels & Sons, Inc. in the amount of $5,525.00. Mayor Moore indicated this would be helpful in preparation of a new budget.

  6. The State Highway Department has a contract to Eaton Asphalt for repaving Mt. Zion Road from U.S. 42 to Gunpowder Creek, which will include a new culvert at Sycamore Drive. Work will commence in the spring and be completed before June 30, 1999.

  7. Whispering Trails – Tony Browne is correcting the storm drain problem as he builds a new house on the vacant lot (lot 32 section 8) which was an eyesore for so long.

Commissioner Jack Johnson reported that he spoke with Mrs. Ross and that she is very pleased with the appearance as well as everything else regarding the gabion work.

OLD BUSINESS:

ORDINANCE NO. 98-006 – An Ordinance proposing to annex to and make a part of the incorporated territory of the City of Union, Kentucky, certain unincorporated territory contiguous to the present lying south and west corporate limits of the City of Union, Kentucky. Mayor Moore mentioned that this is the new section of Hempsteade and he did meet with the Drees Corporation and they have no problem with the City going ahead and bringing this into the City. After discussion, Commissioner J. Johnson made a motion, with second from Commissioner E. Johnson that Ordinance No. 98-006 be passed and approved on second reading and the motion carried unanimously.

ORDINANCE NO. 98-007 – An ordinance establishing a street, driveway and sidewalk maintenance policy. After discussion, Commissioner McClellan made a motion, with second from Commissioner J. Johnson that Ordinance No. 98-007 be passed and approved on second reading and the motion carried unanimously

Resident Mr. Blair of 1616 Sycamore Drive addressed the Commission about the cost of backfill to level out his yard after the curb and resurfacing of Sycamore Drive was completed. Mr. Blair expressed that he paid $240.00 dollars for extra back fill and wants the City to pay. Mr. Rusk will talk with Mr. Riegler after Mayor Moore inspects the area.

Mayor Moore asked the City Clerk what are the date and time of Halloween Treat-or-Treat for the City of Florence? The City Clerk answered Saturday, October 31 from 5:00p.m. - 7:00p.m. The Union City Commission agreed to set the trick or treat hours for the City of Union for Saturday, October 31, 1998 from 5p.m. To 7:p.m.

NEW BUSINESS:

ORDINANCE NO. 98-008 – An Ordinance proposing to annex to and make part of the incorporated territory of the City of Union, Kentucky, certain unincorporated territory contiguous to the present lying south and west corporate limits of the City of Union, Kentucky. After discussion, Commissioner E. Johnson made a 0motion, with second from Commissioner J. Johnson that Ordinance No. 98-008 be passed and approved on first reading and the motion carried unanimously.

ORDINANCE NO. 98-009 – An Ordinance modifying the traffic status of Sycamore Drive from a two-way street designating Sycamore Drive as a one-way street; and providing penalties for violations of this ordinance. After discussion, Commissioner J. Johnson made a motion, with second from Commissioner Hunt that Ordinance No. 98-009 be passed and approved on first reading and the motion carried unanimously.

ORDINANCE NO. 98-010 – An Ordinance amending article 31, section 3149 and article 40 "definitions" of the Boone County zoning regulations and allowing for parking and/or storing recreational vehicles in the incorporated territory of the City of Union, Kentucky. After discussion, Commissioner E. Johnson made a motion, with second from Commissioner J. Johnson that Ordinance No. 98-010 be passed and approved on first reading and the motion carried unanimously.

Resident Ms. Frances Barlow in the audience indicated that she was impressed with the article in the Kentucky Post dated October 12, 1998 and commented that she is in favor of the proposed Union Town Plan dealing with the reconstruction of U.S. 42 and wanted this noted in the minutes.

ADJOURNMENT:

There being no further business to be brought before the Commission, Mayor Moore called for a motion to adjourn. Motion was made by Commissioner E. Johnson, with second by Commissioner J. Johnson, and carried unanimously. Adjournment was at 8:35 p.m.
