MINUTES

REGULAR MEETING

March 8, 1999

CALL TO ORDER

The Regular Meeting of the Union City Commission was called to order by Mayor Warren S. Moore at 7:30 p.m. on Monday, March 8, 1999, in the Union City Building Auditorium.

The following members of the Commission were present: Mr. Jennings, Mr. Johnson, Ms. Logsdon and Mr. McClellan.

Also present were City Engineer Willard Rusk, City Clerk Kathy Porter and City Attorney Greg D. Voss was present in absence of David W. Martin.

Mayor Moore requested a motion to go into Executive Session under KRS 61.810(1)(c) to discuss the City of Florence versus the City of Union litigation regarding annexation. Upon motion of Mr. Jennings, second by Mr. McClellan, that the Commission enters into Executive Session, Motion passed unanimously the time being 7:30 p.m.

Upon motion of Mr. Jennings, second by Ms. Logsdon, that the Commission return from Executive Session to return to the regular city business meeting agenda @ 8:30 p.m. Mayor Moore called for a vote. Motion passed unanimously.

MINUTES

The Minutes of the February 8, 1999, Regular Meeting was presented for approval. Upon motion of Mr. McClellan, second by Mr. Jennings, that the minutes are approved as presented, Mayor Moore called for a vote. Motion passed unanimously.

TREASURER’S REPORT

Mr. Johnson made a motion to approve the treasurer's report as presented, second by Mr. Jennings. Motion passed unanimously.

BILLS FOR PAYMENT

After a brief discussion Mr. Johnson moved to pay the bills as listed, second by Mr. McClellan. Motion passed unanimously.

CORRESPONDENCE

Mayor Moore mentioned a letter received from Behringer-Crawford Museum the home for Northern Kentucky's Natural, Cultural and Artistic Heritage Devou Park. They are requesting a donation of $500 from the City of Union, Kentucky. After discussion the Commission agreed not to donate.

Mayor Moore read a letter dated 3/2/99 received from resident Patricia Smith concerning several comments and issues in Gunpowder Greens that she feels are not being addressed.

Mayor Moore read a letter from Mr. Kunkle who was present in the audience with his son. They expressed their concern to the Commission about the annexation between Union and Florence for the land surrounding Longbranch Road. A portion of Mr. Kunkle's farm lies within the designated area, and he says he does not want to be annexed by either city. Mayor Moore commented that this is all under litigation and asked Attorney Voss to address the meeting as far as questions and concerns regarding the letter received by Mr. Kunkle.

DEPARTMENTAL REPORTS

Mr. Johnson had no report.

CITY ENGINEER REPORT

     

  1. Have met on a couple occasions with Union Presbyterian Church, Sanitation District No. 1 and Zaring Development to discuss the new sanitary sewer and storm water impacts on the church as well as flooding in Union downstream of the church from the Estates at Belmont. There was a meeting today of the Church committee and other departments with Administrator of Boone County that Mr. Rusk wasn't aware of until later.

     

  2. Finished the slab jacking at Hempsteade and Lakeway Court reported that it didn't turn out as satisfactory as he would have liked but thinks it will hold up now until we have other repairs in the area. Still needs to be sealed around the edges.

     

  3. Reported that his last meeting with Rich Hanser resident on Russwill Lane is concerned with septic tank leach lines extending into his property from his neighbor Mr. Finke. Mr. Rusk said that the two residents agreed that Mr. Hanser could go ahead and block the leach lines 5-10' from the property line.

     

  4. Met with people from Northern Kentucky on the storm water problems and the Sanitation District No. 1 and they keep emphasizing to people to make sure they understand that the District will not automatically take over the storm sewer system. They have to get a plan in motion and get each city to agree with it and will require funding.

     

  5. Met with Dan Riegler the second time to go over the punch list items for Sycamore Drive.

     

  6. Met with a Mr. Randy Lovett at 1810 Whispering Trail that has a storm sewer under his front yard and seems to be sinking. Needs a fairly dry day to check it.

     

  7. Inspected the drainage concerns at 9733 Windsor Way, Mr. Ron Doering property. Where the storm sewer is located it doesn't catch all the water and a catch basin may be needed there.

     

  8. Has not received the actual increase in the storm water that could come when it's finally finished. Mayor Moore asked Mr. Rusk to find out what took place at the meeting today.

OLD BUSINESS

Ms. Logsdon distributed a proposal she had prepared and researched for the feasibility of hiring a part time city maintenance person. After her presentation and discussion the Commission members decided to take the proposal home for more consideration, and possibly discuss this further at the next regular business meeting.

Mr. Jennings had researched various options for a complete compensation package for the city clerk. Information had been obtained regarding the figures for the County Employees Retirement System. The city clerk would be required to contribute 5% of her gross salary and the city (Employer) would contribute a rate determined by the Retirement System Board that could vary from year to year. Through this fiscal year the rate is 8.22% of gross salary and starting July 1, 1999 the rate would be 7.28% of gross salary. After discussion, Mayor Moore advised the Attorney to prepare an Ordinance for the City to participate in the County Employees Retirement System and present at next regular business meeting. Upon motion by Mr. Jennings and second by Mr. McClellan to prepare an Ordinance for the retirement plan to present at next regular meeting. Mayor Moore called for a roll call vote. Mr. Jennings - Aye, Mr. Johnson - Aye, Ms. Logsdon - Nay, Mr. McClellan - Aye, Mayor Moore - Aye.

AYES 4 NAYS 1 Motion passed.

NEW BUSINESS

Mr. McClellan reported the results from 134 of the 716 surveys that were mailed to Union residents regarding the U.S. 42 Union Town Plan mentioning that the surveys are still coming in. After presentation, he mentioned that the results are being updated as the surveys are received and encouraged owners to get theirs in if they haven't already. He mentioned that The Long-Range Planning Committee is interested in having approximately twelve to fifteen volunteers to serve on a Citizen/Owner Committee, this committee is going to be a hearing committee for the Union Town Plan. Mr. McClellan stated that he is going to be a liaison and can not be on the committee. The Long-Range Planning Committee will be selecting the people along with David Geohegan of the Boone County Planning Commission.

Mayor Moore mentioned that he received two (2) proposals for Tree & Shrub Care Services for around the city building. TruGreen-ChemLawn proposed total annual cost of $210. Jeff Fields Tree and Shrub Care proposed $215. Mayor Moore advised that this work would possibly be something that could be added to the duties of a city maintenance person if decided to go that route.

Mayor Moore presented to the Commission his budget worksheet for Fiscal Year 1999/2000 and advised the Commission to take this home and review for discussion at the next regular Commission meeting.

Ms. Logsdon mentioned an article she read dated 2/25/99 from the Boone County Recorder regarding Boone County Judge Executive Gary Moore and Florence Mayor Diane Ewing Whalen. The article headlined City, County talk business. Ms. Logsdon stated that she thought Union as well as Walton should be against this because the article seems that Florence would be receiving favor child status in Boone County. Mayor Moore requested Attorney Voss to examine the article and possibly draft a letter to Boone County Fiscal Court.

ADJOURNMENT

Upon motion of Mr. McClellan, second by Mr. Johnson, that the Regular Meeting be adjourned, Mayor Moore called for a vote. Motion passed unanimously. The Commission adjourned at 10:40 p.m.
