MINUTES
CITY COMMISSION MEETING
January 10, 2000
CALL TO ORDER
The Regular Meeting of the Union City Commission was called to order by Mayor Warren S. Moore at 7:30 p.m. on Monday, January 10, 2000 in the Union City Building Auditorium.
The following members of the Commission were present: Mr. Jennings, Mr. Johnson, Mr. McClellan and Ms. Logsdon.
Also in attendance: Attorney Greg D. Voss was present in absence of City Attorney David W. Martin, City Clerk Kathy Porter, and City Engineer Willard Rusk. There were fourteen people in the audience.
APPROVAL OF MINUTES
The Regular Business Meeting Minutes of the December 13, 1999 meeting was presented for approval. Upon motion of Mr. McClellan, second by Mr. Johnson that the Minutes be approved. Motion carried unanimously.
TREASURER’S REPORT
Mr. Johnson made a motion to approve the Treasurer's Report as presented, second by Mr. Jennings. Motion carried unanimously.
BILLS FOR PAYMENT
The bills for payment were reviewed. Ms. Logsdon made a motion to pay the bills as listed with a second by Mr. Jennings. Motion carried unanimously.
AUDIT REPORT
Teresa F. Hudson, CPA presented the City of Union audit for two years ending June 30,1999 as required for sixth class cities. Copies had been given to Commission members. Ms. Hudson explained the combined Balance Sheet for the Fund Types and Account Groups. The revenues showed a 33% increase over the past two years. The Tax revenue makes up 86% of the total revenues. According to Ms. Hudson's report, she found no matter that was considered material weakness involving the internal control over the financial reporting and its operation. No questions pertaining to the report, Mayor Moore thanked Ms. Hudson for her excellent audit presentation and that it is very encouraging to know the City of Union is in compliance, as it is our aim to maintain that status.
BOONE COUNTY PLANNING COMMISSION
Revised Draft Union Town Plan:
Kevin Costello - Executive Director, David Geohegan - Director of Planning Services and John Huth - Planning Services Member of the Boone County Planning Commission presented a preview of the Revised Union Town Plan. Commission members requested this presentation before being presented to the Steering Committee on January 20, 2000. A handout draft of the plan was provided. Mr. Geohegan remarked that complete details would not be discussed, but would be open to questions. A more detailed plan will be presented at the Steering Committee meeting along with the Boone County Fiscal Court and the Union City Commission. The plan presented in 1998 by consultants, Myers Schmalenberger and Meisner Inc. failed the approval of residents and property owners as being too restrictive. The plan revealed tonight, prepared by the Planning Commission. This plan will be brought back to public workshop, as during the past two years, more than 400 people have been involved in this process. This plan was set up on the large part by the 1995 Boone County Comprehensive Plan. After the apparent failure of the 1998 plan, a Steering Committee was formed to act as a liaison for the concerned entities and to provide input to the study. The term "Sprawl" was explained and how it could be addressed by providing citizens a workable and livable atmosphere planned street, traffic and higher density development in a town center. The split road concept is not a part of this plan. The State will build U.S. 42 as was designed. A slide was shown of the basic plan of the State's design and the limited access of the highway. This study area was on approximately 17 - 18 acres. Mr. Huth explained the phases of the plan by referring to each colored coded section for each type of development, residential, commercial and public green spaces. A new portion of U.S. 42 will be east of the city's existing business district and this will open up hundreds of acres of farmland for development. Commercial development will not be allowed along the new roadway, but low small professional offices will be allowed in certain areas. New homes built along old U.S. 42 will be required to have specific setbacks to keep the rural scenery now existing. Mr. Geohegan explained the creation of 3 new zoning districts. Ms. Logsdon and Mr. McClellan had questions on the density and felt it was too high. Mr. Jennings was concerned as to the state building the two larger lakes in the plan and on the density issue. Due to the questions, Mr. Geohegan replied that they were trying to create a plan where no plan existed and this was just preliminary and could be revised. The "laundry list" will help developers to speed up the plan's review and approval process by incorporating its provisions. The Planning and Zoning staff were thanked for their presentation and hard work.

City Engineer Willard H. Rusk, P.E. provided the Commission with updates on the following:
OLD BUSINESS
Mayor Moore gave second reading of ORDINANCE NO. 99-010 - AN ORDINANCE RELATING TO THE ADOPTION AND APPROVAL OF TEXT AMENDMENTS TO ARTICLE 40 OF THE BOONE COUNTY ZONING REGULATIONS AS IT RELATES TO DEFINITIONS FOR PURPOSES OF CLARIFYING AND DEFINING TERMS OR USES FOR APPLYING BOONE COUNTY ZONING REGULATIONS IN THE CITY OF UNION, KENTUCKY. Motion to approve by Mr. McClellan, second by Mr. Jennings. Motion passed.
Mayor Moore gave second reading of ORDINANCE NO. 99-011 - AN ORDINANCE RELATING TO THE ADOPTION AND APPROVAL OF TEXT AMENDMENTS TO ARTICLE 10 AS IT RELATES TO THE COMMERCIAL TWO (C-2) ZONING DISTRICT AS SET FORTH IN THE 1996 BOONE COUNTY ZONING REGULATIONS APPLICABLE TO THE CITY OF UNION, KENTUCKY, THESE AMENDMENTS RELATING TO ATTACHED DWELLING UNITS WITHIN THE C-2 ZONE. Motion to approve by Mr. Jennings, second by Mr. McClellan. Motion passed.
Mayor Moore gave second reading of ORDINANCE NO. 99-012 - AN ORDINANCE RELATING TO THE ADOPTION AND APPROVAL OF TEXT AMENDMENTS TO ARTICLE 31 AND ARTICLE 40 OF THE 1996 BOONE COUNTY ZONING REGULATIONS APPLICABLE TO THE CITY OF UNION, KENTUCKY TO REGULATE WIRELESS COMMUNICATION FACILITIES AND SERVICES. Motion to approve by Ms. Logsdon, second by Mr. Johnson. Motion passed.
Attorney Voss advised the City Commission on the Kroger Lawsuit that every party involved has filed motions for summary judgements that the matter is set for hearing before Judge Bamberger for status conference.
ANNOUNCEMENT
Mayor Moore advised the Commission that State Representative, Paul Marcotte submitted House Bill number 257 to change the classification of Union from the sixth class to fifth class cities and was filed on January 5, 2000 and went to the Local Government Committee on January 6.
NEW BUSINESS
Mayor Moore reported that two people expressed interest in serving on the Boone County Planning Commission as Union's representative, Randy Barlow and Jack Hunt. Mayor Moore read a letter received from resident Jack Hunt and recognized that Mr. Barlow and Mr. Hunt were in the audience. After reading Mr. Hunt's letter expressing that he could serve the City and County well, because he has been involved and participated in many issues regarding both entities. He has remained an informed citizen, which he feels his input would be valuable in future planning. Mr. Barlow was recognized and asked to express his interest. Mr. Barlow commented that he has served as a City Commissioner and was involved in the original zoning of the city. He has an interest in seeing Boone County not just the Union area work towards planned development and work on plans that will affect this area. Stating that he has been involved in many issues with Florence when they were trying to take over some of the incorporated area of the city due to the density. He thinks he could represent both the city and county well. After discussion by commission members concerning experience and residency, Mr. McClellan nominated Mr. Hunt and Mr. Barlow. No further nominations, Mayor Moore asked for nominations to be closed. Motion for nominations to cease by Mr. McClellan. Second by Ms. Logsdon. Motion carried. Mayor Moore asked for a motion to appoint Randy Barlow as City of Union Representative to Boone County Planning Commission to signify by saying aye. Mayor Moore - Aye, Mr. Jennings - Aye, Mr. Johnson - Aye, Mr. McClellan - Aye. Four (4) Ayes. Mayor Moore asked for votes in favor of appointing Jack Hunt to the position. Ms. Logsdon - Aye. Mayor Moore called for a roll call vote. Mr. Jennings, - Barlow, Mr. Johnson - Barlow, Ms. Logsdon - Hunt, Mr. McClellan - Barlow, Mayor Moore - Barlow. Four (4) to One (1) votes in favor of appointing Mr. Barlow. Motion passed.
Mayor Moore administered the Oath of Office to Mr. Randy Barlow appointing him as Union Representative to Boone County Planning Commission to complete the term that was due to the resignation of Phil Damstrom term of office expiring on December 31, 2000.
ADJOURNMENT
Upon motion of Mr. Johnson, second by Mr. Jennings that the Regular Meeting be adjourned, Mayor Moore called for a vote. Motion carried unanimously. The time being 9:30 p.m.
