COMMISSION MEETING MINUTES

August 14, 2000

 

CALL TO ORDER

Mayor Warren S. Moore called the regular business meeting of the Union City Commission to order at 7:34 p.m. in the Auditorium of the Union City Building.

Commissioners in attendance were Jonathan Jennings, Eddie Johnson, Wayne McClellan, and Gary McCormick.

Also in attendance was Attorney Greg D. Voss, representing in absentia City Attorney David W. Martin and City Clerk Kathy Porter. Absent was City Engineer Willard Rusk he was on a mission trip to Tanzania. There were 37 citizens present at this meeting.

MINUTES

Mr. McCellan moved to approve the Minutes of the July 10, 2000 Commission Meeting. Second by Mr. McCormick. Mayor Moore called for a vote. Motion passed unanimously.

TREASURER'S REPORT

Mr. McCormick made a motion to accept the treasurer's report as presented. Mr. Jennings seconded the motion. Motion passed unanimously.

BILLS FOR PAYMENT

Mayor Moore noted that there is a bill listed for PC ON CALL for hard drive replacement explaining that the city computer died and we had to hire a local company to replace the hard drive. Mr. McClellan made a motion to pay the bills. Second by Mr. Jennings. Mayor Moore called for a vote, motion passed unanimously.

CORRESPONDENCE

Mayor Moore read a letter dated July 27, 2000 from Fred J. Gunnels Real Estate Broker of Richard Connor Riley & Associates, L.L.C. who have been retained by Metricom, Inc. to secure a right-of-way (ROW) agreement on its behalf with the City of Union. Metricom is seeking the municipality’s approval to deploy its technology through a ROW Agreement, by which Metricom will ensure that the placement of radio transmitters will not hinder the city financially or aesthetically.

Mayor Moore read a letter dated July 31, 2000 from Ken Ralenkotter of 10251 Hempsteade Drive regarding the recent enforcement of Union City Ordinance No. 85-012. Mr. Ralenkotter requested in his letter an immediate suspension of said Ordinance for the following streets: Hempsteade Drive, Bayswater Drive and Cedarwood Drive.

Mayor Moore read a letter dated August 1, 2000 from William F. Madden, P.E. District Traffic Engineer Kentucky Transportation Cabinet regarding the results of the traffic signal study at the intersection of U.S. 42 and Whispering Trail. The letter stated that when considering the installation of a traffic signal, the Transportation Cabinet complies with federal guidelines called warrants. These warrants establish minimum conditions under which signal installations may be justified, and based on the volume of traffic and the crash history, they do not believe a traffic signal is warranted at this time.

Mayor Moore read a letter dated August 4, 2000 from Association Administrators, Inc. Managing Agent for Hempsteade Board of Directors regarding the stop signs fading and speed bumps need repainted. Mayor Moore commented that Mr. Rusk had contacted Mayor Moore about the signs and that there is a useable lifetime limit to the signs and that Mr. Rusk will be getting them replaced when he returns from his trip.

SPECIAL PRESENTATION

Mr. Fred J. Gunnels is employed with Richard Connor Riley & Associates, L.L.C. and Metricom, Inc. which has developed a technology, which operates under the trade name "Ricochet", has retained their company to secure a right-of-way (ROW) agreement on its behalf with the City of Union. Ricochet provides users of computer systems wireless access to the Internet. The company is seeking right-of-way agreements with cities in order to place Poletop Radios on telephone pole transmitters. They are asking for a nine-year agreement with three, five-year re-news. They would like to have this up and running in the greater Cincinnati area by the end of the year. To help cities understand the project representatives of Metricom, Incorporated is proposing a meeting to give an outline of the project and answer questions regarding the right-of-way agreements being proposed. The meeting will be at the Northern Kentucky Area Development District on August 25, 2000 from 1:00 – 3:00 p.m. Mr. McClellan asked where the base-station would be located? Mr. Gunnel commented that the Engineers would determine the locations. They would not be located in every city, would be similar to cellular housing. This agreement deals with the radio transmitter only. Mayor Moore thanked Mr. Gunnel for his presentation and advised that our attorney will review the agreement to determine if any changes need to be made before acceptance by the City.

CITIZENS ON THE AGENDA

Mr. Ken Ralenkotter and Mr. Wes Nelson wanted questions answered in regard to their letters presented to the Commission about Ordinance 1985-012. Why the sudden enforcement of the no parking on city streets and the cost of new signs. Was informed that first it was a safety factor regarding children. New signs were warranted, as paint on the signs was not visible. They were requesting that no parking be allowed in the cul-de-sacs and on the side of the streets with fire hydrants, but to allow parking elsewhere in Hempsteade. It is their utmost desire to provide safety for the motorist and the citizens. Therefore, the Commission was asked to thoroughly review the Ordinance to how it would affect all the streets in the City.

Mr. Michael Trout and Mr. Earl Hall, Jr. along with other citizens of Whispering Trail were present to express their concerns of the traffic restrictions at the intersection of U. S. 42 and Whispering Trail as it relates to the Union Town Plan. The Commission was presented with a petition with 75 signatures requesting an amendment to the Union Town Plan to prohibit access from Whispering Trails for any business that may locate on the properties re-zoned as Union Neighborhood Office.

DEPARTMENTAL REPORTS

Public Works: City Engineer Willard H. Rusk was absent. Mr. Rusk conferred with Mayor Moore before he left on his trip and all public works seemed to be in order.

OLD BUSINESS

At this time David Geohegan, Director of Planning Services gave a brief history of the Union Town Plan in regards to several comments and concerns that were received concerning the no-access provision to Whispering Trail. The plan designated two parcels at the intersection of Whispering Trail and U.S. 42 as professional office zone. At a public meeting in January, the plan specified no-access from the two parcels onto Whispering Trail. Mr. Geohegan said the no-access provision was deleted sometime in late March. Residents of Whispering Trail wanted the restriction put back on the Union Town Plan. After much discussion and hearing comments from several residents of Whispering Trail. Mr. Geohegan and Kevin Costello gave several suggestions and alternatives if the City Commission disagreed with the plan as presented. The City Attorney advised the Commission they could make a modification to the Union Town Plan, but the process of adopting the ordinance would require a first reading of the revised ordinance and then a second reading at a later date. The Commission agreed to modify the ordinance designating the two parcels to be zoned Rural Suburban/Union Neighborhood Office (RS/UNO) and must have access through neighboring parcels, adjacent development, or directly from new U.S. 42, and shall not be accessed from Whispering Trails. A revised ordinance was drafted while the meeting continued.

Second reading of Ordinance No. 2000-006 – AN ORDINANCE OF THE UNION CITY COMMISSION ADOPTING THE UNION TOWN PLAN AS A SPECIAL LAND USE, ZONING AND DESIGN CORRIDOR STUDY FOR A 1,850 ACRE AREA GENERALLY LOCATED WEST OF OLD U.S. 42, WEST OF UNION VILLAGE AND PLANTATION POINTE SUBDIVISIONS, SOUTH OF LONGBRANCH ROAD AND NORTH OF RICE PIKE, THIS STUDY AREA BEING LOCATED PARTLY IN THE CITY LIMITS OF UNION, KENTUCKY AND PARTLY IN UNINCORPORATED AREA OF BOONE COUNTY, KENTUCKY. Ordinance failed for lack of a motion.

NEW BUSINESS

At this time Mayor Moore gave a brief history of Ordinance No. 85-012 - An Ordinance Governing the Parking of Motor Vehicles within the City Limits of Union, Kentucky. Mayor Moore stated that the reason we put up the no-parking signs originally was for the safety of the kids. The Commission is willing to work with the residents of Hempsteade, but do not plan to create an ordinance just for their street, an ordinance would be created for the safety and convenience for all streets in the city. After hearing comments and concerns from residents the City Commission gave some consideration to changing the ordinance. Mayor Moore commented that his first concern is public safety and convenience second. The City Commission will continue review and replacement of Ordinance No. 85-012 under old business at the next regular business meeting.

First reading of Ordinance No. 2000-007 - AN ORDINANCE OF THE UNION CITY COMMISSION ADOPTING AS MODIFIED THE UNION TOWN PLAN AS A SPECIAL LAND USE, ZONING AND DESIGN CORRIDOR STUDY FOR A 1,850 ACRE AREA GENERALLY LOCATED WEST OF OLD U.S. 42, WEST OF UNION VILLAGE AND PLANTATION POINTE SUBDIVISIONS, SOUTH OF LONGBRANCH ROAD AND NORTH OF RICE PIKE, THIS STUDY AREA BEING LOCATED PARTLY IN THE CITY LIMITS OF UNION, KENTUCKY AND PARTLY IN UNINCORPORATED AREA OF BOONE COUNTY, KENTUCKY. A motion to pass on first reading of Ordinance No. 2000-007 was made by Mr. McClellan with second by Mr. Jennings. Motion passed unanimously.

Mayor Moore asked the Commissioners if they would like to schedule a special meeting in two weeks for the second reading of Ordinance No. 2000-007. The Commission agreed to have a special meeting set for Monday, August 28, 2000 at 7:30 p.m. for second reading of Ordinance No. 2000-007.

ADJOURNMENT

No further business to discuss Mr. Jennings adjourned the meeting at 9:48 p.m. Mr. McCormick second the motion. Motion passed unanimously.
