COMMISION MEETING

MINUTES

August 13, 2001

 

CALL TO ORDER

Mayor Warren S. Moore called the regular business meeting of the Union City Commission to order at 7:32 p.m. in the Auditorium of the Union City Building.

Commissioners in attendance were: Mr. Jennings, Mr. Kirby and Mr. McClellan. Absent: Commissioner McCormick.

Also present were: City Clerk Kathy Porter, Attorney Greg Voss in the absence of City Attorney David Martin and City Engineer Willard Rusk.

APPROVAL OF MINUTES:

Mr. Kirby asked that the minutes be amended that he was not present at the July 09, 2001 meeting.

Mr. Jennings made a motion to approve the Regular Business Meeting Minutes of July 09, 2001 as amended, seconded by Mr. McClellan. Motion carried unanimously.

TREASURER’S REPORT:

Treasurer’s Report as of July 31, 2001 was read and presented for acceptance by Mayor Moore. Motion to accept as presented was made by Mr. McClellan and seconded by Mr. Kirby. Motion carried unanimously.

BILLS FOR PAYMENT:

Motion to pay the bills as presented by Mr. Jennings and seconded by Mr. Kirby. Motion carried unanimously.

CORRESPONDENCE:

Mr. McClellan introduced the letter he received from Kentucky Transportation Cabinet dated July 16, 2001. He reported that in order for the Department of Highways to install the requested green space medians there must be a formal maintenance agreement between the city and the department. They need to have the plans down next month. Mr. Jennings asked if there was any reason not to sign the agreement and Mr. McClellan commented that the only downside to this is in the long run this would add more cost to city maintenance. The city will have to maintain these areas perpetually and this is only in the area where we requested the medians basically in the new town center area. Mr. McClellan said this would give us some green space that we otherwise would not have unless we sign the agreement. After discussion, City Attorney Greg Voss put into legal term for an Executive Order to authorize the Mayor to execute any annullable agreements necessary to insure that the medians along Highway 42 are installed. Motion to accept by Mr. Jennings and seconded by Mr. McClellan. Motion carried unanimously. Attorney Voss will prepare an Executive Order for Mayor Moore to sign. (Municipal Order No. 01-003 Authorizing the signing of a maintenance agreement for the maintenance of the medians on U.S. Highway 42 through Union, Kentucky was executed).

Mayor Moore read the newspaper clipping from the Kentucky Post that mentioned the position open on the Union Board of Adjustment. Resident Mrs. Sharon Bellan, 1966 Mt. Zion Road was the only one that responded to the advertisement and was present in the audience tonight. Mayor Moore commented that he was pleased that she was interested and thanked her for volunteering to serve. Mayor Moore moved that Sharon Bellan be appointed to serve on the Union Board of Adjustment. Motion made by Mr. McClellan and seconded by Mr. Kirby. Motion carried unanimously.

 

 

CITY ENGINEER REPORT:

Willard H. Rusk, P.E. reported on the following:

  1. Reported a bad accident on U.S. 42 and Rice Pike. Received a call that the weeds were sticking out far. Inspected the area and this area is in the State and County jurisdiction. One of the two got the grass cut and mowed in that corner a little better than before.

  2. Received several calls on the trench drain being installed on Whispering Trail the owner and contractor was getting the road put in and the concrete is anticipated to be poured either this week or next. Mud was running in the street and needed cleaned up. Once the road is in it should work well.

  3. Lou Hodges on Whispering Trail is going to repave and do some work on his driveway. Being that a span of a storm sewer culvert that goes in there Mr. Rusk wanted to get it cleaned out good enough to tell if the culvert is in good shape so that it was not paved over and have to tear it up again if a few years. Mr. Rusk was able to check it and the resident down stream Mr. Jim Bell right next door was concerned that there were some marks in his bank at the flowage easement area and wanted it cleaned up. Mr. Rusk told him that it could not all be done at one time. No since in going in and cleaning it up and tearing it up when they put in a storm drain. He seems to be satisfied. Mr. Rusk commented that Whispering Trail is one of the streets that we will be spending some money on in the future. There are several places that need some work but waiting on the new U.S. 42 because they will be tearing up part of the road.

  4. Skyline Chili is coming along well. Talked with them about keeping the mud off the street. What is there should not be beyond the property line on the streets. At this time this is an isolated area. When the developer built that area he didn’t pave it clear to the property line of Union and Florence.

  5. Spoke with Tony and Jim Berling about several concerns in Union Village Subdivision. Mr. Rusk may be writing them a letter and list all the items, because there is a street that doesn’t show that is suppose to connect into Arbor Springs and they have not built the T off the main road to it and the sidewalk doesn’t connect. What the rules are for the big detention pond and a few other odds and ends.

  6. Burleigh Lane in Hempsteade has a broken section of curb. Mr. Rusk will get in touch with Mr. John Prodoehl of Drees because Mr. Rusk personally thinks that they should take this out and put back in bec ause it has sunk a lot and this is not normal. Also, will be talking to him about the detention pond in there it is bad news right now.

  7. The large culvert that goes under Hempsteade has a considerable amount of trash in the fenced area and the person that is supposed to take care of this hasn’t. Will be calling to get some repairs done in one or two places on the fence.

  8. The little drain on Aspen Place in Lassing Green was authorized to be fixed last year however there was a resident who was going to do some work there and he was off due to a death in the family and when he returned the weather turned cold. A letter was received from a resident next door to Mrs. Harvey that was concerned that his driveway was going to be cut. Talked with the cable people and they can pull a two inch cable and believes this will work satisfactory and be a lot cheaper than the big size storm drain that was going to be put in there. Talked with the four residents involved, the cable people, the resident that was a little upset of possibly cutting his driveway and he seems to feel that this will satisfy his concerns. Mr. Rusk wrote him a letter and one to Mrs. Harvey and talked to the builder who is going to hook this up when done. This will be done in the next two or three weeks and cost approximately $2,500.

  9. Received a call from Mary Ann Johnson who lives on the left at the short cul-de-sac off Golden Pond. The Johnson’s would like to put in a driveway to pull their trailer in their yard. Mr. Rusk doesn’t see any problem with it and will require them to file an encroachment permit asking to hook into the City Street. Mr. Rusk will see that it’s put in properly. Mr. Rusk explained that they are not going to park it there for any length of time this is simply for them to get the trailer inside their fence so that they can load it up and clean it.

Mr. McClellan asked that the big tree in front of the city building be trimmed.

Mr. Kirby inquired about the state responsibility of the tree limbs hanging on the road when you’re driving on Mt. Zion Road from Gunpowder. Mr. Rusk commented that the road it’s self is the state responsibility and that the city has cut a few limbs in a few place along that road. Mr. Rusk will mention these areas to Tom Shoemaker, Boone County Maintenance Engineer.

OLD BUSINESS:

None presented.

NEW BUSINESS:

Mayor Moore recognized resident Don Harden of 1700 Sherman Court. Mr. Harden is on the Board of the Union Village Home Owners Association. He reminded the Commission that he was at a city meeting in the winter expressing the concerns that they are experiencing with the speeding issues specifically on Braxton Road and Richmond Road. He commented that there is one stop sign and that is at the end of Richmond Road and at the end of Braxton Road. Mr. Harden inquired about putting up speed bumps and Mayor Moore explained that the City Attorney did some research regarding the speed plateaus that were put up on Hempsteade Drive and it turns out that it is the state prerogative on traffic control devices for the state. The state has control of all traffic controls and the city does not have the authority to put them in. Mayor Moore asked the City Clerk to contact Boone County and have them monitor speeding and do traffic enforcement in this area.

Mayor Moore instructed Mr. Rusk to have stop signs installed where there is a T or a cross road. Also, put a three way stop at Kroger.

Mrs. Rhonda Hinkle Union Village resident asked if striping could be painted on Richmond Road for lane markers. There is a problem with the traffic that is coming out of Kroger and where the road enters onto Richmond Road from the Skyline Chili area. Mr. Rusk commented that this could be done on a city street.

The Union Village residents present in the audience tonight asked if they could get a street id sign put up for Richmond Road. Mr. Rusk said that this is one of those issues along with a gas street light that he will be talking to Mr. Berling about.

Mr. McClellan moved to adjourn meeting at 8:25 p.m. Seconded by Mr. Kirby. Motion carried unanimously.
