MINUTES
September 10, 2001
PUBLIC HEARING ON PROPERTY TAX RATE
Mayor Warren Moore called the Public Hearing to order at 7:30 p.m. Present were Commissioners Don Kirby, Gary McCormick and Wayne McClellan. Also in attendance were City Attorney Greg D. Voss and City Clerk Kathy Porter.
The purpose of the public hearing was to discuss and hear written and oral comments or suggestions on the proposed property tax rate for the 2001 tax year. Mayor Moore explained the procedure steps for a city in setting the property tax rate. The Commissioners reviewed the tax rate calculation information along with the budget comparison. Mayor Moore asked if there is any discussion. Mr. Kirby added that with some of the newer neighborhoods the city streets are going to be getting to the point that the city streets will be in need of repaving and repairs and don’t want to under estimate that need. Mayor Moore commented that we are running a surplus and have for several years and this surplus is slowly building up. Mr. McClellan suggested that we stay with the tax rate that we had the preceding year. Mr. McCormick commented that the reason we are going to have that considerable increase in income is going to be because of property value increase and new properties added. After hearing comments from the Commission Mayor Moore confirmed that the consensus is to keep the rate the same as preceding year. Mayor Moore asked if anyone in the audience had comments. There were no written or oral comments received. Mayor Moore called for a motion to adjourn the public hearing. Motion to adjourn was made by Mr. Kirby and seconded by Mr. McCormick. Motion carried unanimously.
CALL TO ORDER REGULAR BUSINESS MEETING
Mayor Warren S. Moore called the regular business meeting of the Union City Commission to order at 7:40 p.m. in the Auditorium of the Union City Building.
Commissioners in attendance were: Mr. Kirby, Mr. McClellan and Mr. McCormick. Absent: Commissioner Jennings.
Also present were: City Clerk Kathy Porter and Attorney Greg Voss in the absence of City Attorney David Martin.
APPROVAL OF MINUTES:
Mr. McClellan made a motion to approve the Regular Business Meeting Minutes of August 13, 2001 seconded by Mr. Kirby. Motion carried unanimously.
TREASURER’S REPORT:
Treasurer’s Report as of August 31, 2001 was read and presented for acceptance by Mayor Moore. Motion to accept as presented was made by Mr. McCormick and seconded by Mr. Kirby. Motion carried unanimously.
BILLS FOR PAYMENT:
Motion to pay the bills as presented by Mr. Kirby and seconded by Mr. McCormick. Motion carried unanimously.
AUDIT REPORT:
Mrs. Terri Hudson, CPA presented the Audit of Financial Statements for the year ending June 30, 2001 to the Commission. Mrs. Hudson reviewed the annual audit report with the Commission present. After review motion to accept the audit report was made by Mr. McClellan and seconded by Commissioner Kirby. Motion carried unanimously.
CORRESPONDENCE:
Mayor Moore read a letter he received from Boone County Planning Commission congratulating Ms. Bellan on her appointment to the Union Board of Adjustment.
Mayor Moore read a thank you satisfactory letter that City Engineer, Willard Rusk received from resident Brian T. Schlueter of 10690 Aspen Place regarding the drain line for his street.
CITY ENGINEER REPORT:
Mayor Moore noted that City Engineer, Willard H. Rusk is absent tonight he is currently on a mission trip and vacation during the 4th through 26th of September. Mayor Moore reported the following items from a memorandum that Mr. Rusk provided to Mayor Moore.
PLANNING & ZONING REPORT:
Mr. Randy Barlow was not present to give a report.
OLD BUSINESS:
None presented.
NEW BUSINESS:
Mayor Moore recognized resident Anna Hitzel of 973 Lakepointe Court in Hempsteade Subdivision. Ms. Hitzel reminded the Commission that she attended a city meeting this time last year with a petition from the homeowners on her street with the exception of two, asking for something to be done about the speeding of vehicles in a 20 mph speed zone. The problem still exists and she wants to see something done about it. She commented that additional signs could be installed or the small skinny speed bumps. City Attorney Greg Voss advised that the speed bumps are a state traffic control device that is not to be used on roads. There are people breaking the law and the sheriff’s department will be contacted. Commissioner McCormick asked City Attorney Greg Voss what is our contractual agreement with the sheriff’s department. City Attorney Voss commented that this is something that needs to be looked at since the merger of the Boone County Police and the Sheriff’s Department because the Sheriff is a constitutional and created entity. Commissioner McCormick asked how would the Sheriff throughout the main thoroughfares through the county prioritize the City of Union. Commissioner Kirby commented that maybe the Sheriffs department would be interested in a joint agreement substation here in Union like what they are doing with the City of Walton. After much discussion Attorney Voss agreed to set up a meeting with the Boone County Sheriff Michael Helmig and City Commissioner Kirby and Commissioner McCormick to discuss some issues and concerns that the city has.
Mayor Moore noted that a complaint report has been filed regarding the noise and the hours of deliveries being made at the Kroger Store. Here are a few of the concerns: The delivery trucks leave their trucks running during their 45-minute delivery, which is very noisy inside the house on the street directly behind Krogers. Deliveries Monday thru Saturday between 6am and 7am and deliveries after 11pm and deliveries at 3am in the morning. After discussion, Attorney Voss agreed to contact the Erlanger and Madera Kroger Stores and find out what their city arrangement is with restrictions on deliveries. Also, Attorney Voss will review the Nuisance Ordinance for a possible update. Mayor Moore asked that the Kroger store manager be notified that we’ve had this problem and that it’s continuing and would rather not involve legalities if we don’t have to. They should be able to do something to keep the trucks from running.
Mayor Moore recognized Barb MacMillan resident of Lassing Green Subdivision. Ms. MacMillan presented a petition signed by the majority of the residents of Lassing Green for the City of Union to install and maintain streetlights within Lassing Green Subdivision. Mayor Moore gave them the history on the beginning start of the first installation. Mrs. McMillian was also informing that the beds at the entrance to Lassing Green are not being kept and lights in the area are burnt out. Mayor Moore suggested that the list of items of concerns be left to give to the City Engineer for evaluation.
Mr. McClellan made a motion to set the date and hours for Halloween Trick-or-Treat to follow whatever the City of Florence decides. Seconded by Mr. McCormick. Motion passed unanimously.
First reading of Ordinance No. 2001-005 – AN ORDINANCE LEVYING AND FIXING THE TAX RATES OF THE CITY OF UNION, KENTUCKY, FOR THE FISCAL YEAR OF 2001-2001, LEVYING SAID TAX UPON REAL, AND TANGIBLE PROPERTY; FIXING THE DATE OF PAYMENT, DISCOUNT PAYMENT, DELINQUENCY AND INTEREST CHARGES; FIXING THE PURPOSE THEREFORE; AND SETTING FORTH THE PROCEDURE FOR COLLECTION OF TAXES. Mr. McClellan moved to accept the first reading and seconded by Mr. Kirby. Motion carried unanimously. Second reading of Ordinance No. 2001-005 will be at the October regular meeting.
No other new business was reported.

Mr. Kirby moved to adjourn meeting at 8:30p.m. Seconded by Mr. McCormick. Motion carried unanimously.
