COMMISION MEETING

MINUTES

October 8, 2001

 

CALL TO ORDER

Mayor Warren S. Moore called the regular business meeting of the Union City Commission to order at 7:35 p.m. in the Auditorium of the Union City Building.

Commissioners in attendance were: Mr. Kirby and Mr. McCormick. Absent: Commissioner Jennings and McClellan.

Also present were: City Clerk Kathy Porter, City Engineer Willard H. Rusk and City Attorney David W. Martin.

APPROVAL OF MINUTES:

Mr. McCormick made a motion to approve the Regular Business Meeting Minutes of September 10, 2001 seconded by Mr. Kirby. Motion carried unanimously.

TREASURER’S REPORT:

Treasurer’s Report as of September 30, 2001 was read and presented for acceptance by Mayor Moore. Motion to accept as presented was made by Mr. Kirby and seconded by Mr. McCormick. Motion carried unanimously.

BILLS FOR PAYMENT:

Mayor Moore mentioned that there is one bill for payment that is not listed on the bills for payment and that is for Baker Mowing in the amount $2,893.00. Motion to pay the bills as presented with the additional bill presented in the amount of $2,893.00 for Baker Mowing Service was made by Mr. McCormick and seconded by Mr. Kirby. Motion carried unanimously.

CORRESPONDENCE:

Mayor Moore commented that a lot of complaint reports were received about the landscaping, mowing, lighting, etc. near the entrance of Lassing Green Subdivision. City Engineer will address this in his report.

Mayor Moore read an invitation to the Municipal Government League of Northern Kentucky Annual Dinner Meeting. The meeting will be held Saturday, November 17, 2001 at the Marquise Banquet Center, Wilder, Kentucky. Mayor Moore advised the Commission if they would be interested in attending to let the City Clerk know and she would make their reservation.

CITY ENGINEER REPORT:

City Engineer, Willard H. Rusk reported on the following:

  1. Mr. Rusk commented that he did not think all the citizens’ complaints regarding Lassing Green were legitimate. The fence was painted fully last July with two coats of paint, there are no weeds coming up through the white board fence. The entrance area did need some weeds pulled and after showing Mr. Baker what needed to be done it is now completed to satisfaction and the entrance area has been improved. The sprinkler system has been broken two or three times by the contractor and it took a little time to get it fixed. The lights that shine on the sign are on a timer and due to power outages the timer needed to be reset, they are now working at the appropriate times. One of the fixture post-lights had been damaged by vandalism and after installing new bulbs they are now working. Mr. Rusk commented that there are four lights in each one of the fixtures, they get hot and sometime they will need to be replaced.

     

  2. Skyline Chili has a serious parking lot problem because of drainage.

  3. All the streets are striped and stop signs were installed at Union Village Subdivision as requested at the last meeting.

  4. Has a continuous problem with the encroachment permit for a trench drain for Keith Hill on Whispering Trail. Mr. Rusk said he plans to discuss the concern with Mr. Hill tomorrow and tell him that he needs to complete the driveway soon to comply with the encroachment permit.

  5. Russwill Lane property that has all the junk, they have done some work of cleaning up but when inspected last week the van was still there and the original concern included a pick-up truck in the driveway, was told that it was abandoned but it still had a current license plate at that time which has since expired. The area does not look good but some work has been completed and Mr. Rusk intends to mail them another letter.

  6. Received another improvement plan for Arbor Springs with the retention, detention calculations and will take sometime to review.

  7. The state indicated that it would be after the first of the year before U. S. 42 gets awarded.

  8. The bridge over Mt. Zion Road should be awarded this month. The bridge is a two and a half million-dollar project there are a lot of utilities to be relocated. They will build a temporary bridge along the side of the existing bridge. The estimated completion is 1-½ years.

  9. Mr. Rusk commented that he forwarded documents to the City Attorney for review regarding the property of (John and Viola Carroll - Haven Manor Subdivision) flooding/flowage easement that Tom Nienaber is working on for the county.

  10. Mr. Paul Kahman has completed the hook-up to the city public drain on Aspen Place for Carol Harvey. Two other residents Brian Schlueter and Mr. Jackson are planning to tie into the public drain also. Letters have been sent to them along with a drawing showing them how to tie into the drain.

  11. The City received reimbursement from John Harkrader Construction Co. for the several minor problems concerning the sprinkler system at Lassing Green Subdivision, which surfaced during construction of the corner house.

  12. Mr. Rusk has been concerned when work is completed on storm sewers and roads as to whom is checking to insure the construction is complete as far as Planning and Zoning and the City of Union, who has spoken with Mr. Costello at the Boone County Planning Commission. One of the items of concern is in Union Village where the builders are pushing dirt into the ravine and prevents the drain from flowing into the detention pond as designed. The neighbors have complained about stagnant water and talked with Jim & Tony Berling but have not received an answer yet. Mr. Rusk will put this in writing and set up a time to meet with them.

  13. Will be meeting with a representative of Cinergy to discuss the streetlights for Lassing Green Subdivision on Monday, October 15, 2001. Mr. Rusk asked about planting seasonal flowers at the entrance area of Lassing Green. Mayor Moore commented that there were no seasonal flowers provided for the entrance area when the plan was approved and the city agreed to maintain the entrance. The Mayor concurred that the city would not provide seasonal flowers but if the residents want to plant seasonal flowers at their cost this could be arranged in the future to further enhance the area.

  14. Mr. Kirby asked if Cinergy re-placed the lights in Hempsteade. Mr. Rusk reported that they are working now at the Mt. Zion Road entrance, also one located in Hempsteade. Mr. Kirby asked about the pothole. Mr. Rusk commented that it is not that bad and is very expensive to repair a single pot-hole, but will be completed as others are done. Mr. Kirby asked if anyone called him back regarding this? Mr. Rusk answered no.

PLANNING & ZONING REPORT:

Mr. Randy Barlow, City of Union Representative reported that the Baptist Church is putting in a storm sewer main, this will be a force main that will pump to the gravity sewer manhole near the medical building.

Mr. Kirby asked why the Sprint tower application was pulled. Mr. Barlow commented that a lot of emphases put on co-location and in the process Sprint has been asked to supply evidence of what they’ve done, where they’ve looked, why it won’t work etc… It has been scheduled to come through the design review committee twice and both times it’s been delayed. They’re due up again in November to come back.

OLD BUSINESS:

Second reading of Ordinance No. 2001-005 – AN ORDINANCE LEVYING AND FIXING THE TAX RATES OF THE CITY OF UNION, KENTUCKY, FOR THE FISCAL YEAR OF 2001-2001, LEVYING SAID TAX UPON REAL, AND TANGIBLE PROPERTY; FIXING THE DATE OF PAYMENT, DISCOUNT PAYMENT, DELINQUENCY AND INTEREST CHARGES; FIXING THE PURPOSE THEREFORE; AND SETTING FORTH THE PROCEDURE FOR COLLECTION OF TAXES. Motion to approve on second and final reading was made by Mr. Kirby and seconded by Mr. McCormick. Motion carried unanimously.

NEW BUSINESS:

Mayor Moore noted that an overall review was made of the City Nuisances Ordinance and after review with the City Attorney presented an Ordinance that will address unlawful noises only and would repeal the sections of the old Nuisance Ordinance that dealt with it.

First reading of Ordinance No. 2001-006 – AN ORDINANCE PROHIBITING UNLAWFUL NOISES WITHIN THE CITY OF UNION, KENTUCKY. Motion to accept the first reading made by Mr. McCormick and seconded by Mr. Kirby. Motion carried unanimously. Second reading of Ordinance No. 2001-005 will be at the November meeting.

Mayor Moore noted that the November regular meeting needs to be re-scheduled because of the City Building would be closed for the Veterans Day Holiday. After discussion the Commission agreed to have the regular November business meeting on Monday, November 5, 2001 at 7:30 p.m.

ANNOUNCEMENT:

Mayor Moore announced that the Halloween Trick-or-Treat hours for Boone County, Florence, Union and Walton would be held on Wednesday, October 31st from 6:p.m. to 8:p.m.

ADJOURNMENT:

Mr. Kirby moved to adjourn meeting at 8:25 p.m. Seconded by Mr. McCormick. Motion carried unanimously.
