COMMISSION MEETING

MINUTES

December 10, 2001

 

CALL TO ORDER

Mayor Warren S. Moore called the regular business meeting of the Union City Commission to order at 7:30 p.m. in the Auditorium of the Union City Building.

Commissioners in attendance were: Mr. Jennings, Mr. Kirby, Mr. McClellan and Mr. McCormick.

Also present were: City Clerk Kathy Porter, City Engineer Willard H. Rusk and Attorney Greg D. Voss in absence of City Attorney David W. Martin.

APPROVAL OF MINUTES:

Mr. McClellan made a motion to approve the Special Meeting Minutes of November 5, 2001 seconded by Mr. Kirby. Motion carried unanimously.

TREASURER’S REPORT:

Treasurer’s Report as of November 30, 2001 was read and presented for acceptance by Mayor Moore. Motion to accept as presented was made by Mr. Jennings and seconded by Mr. McCormick. Motion carried unanimously.

BILLS FOR PAYMENT:

Mayor Moore presented the bills for payment for review. Motion to pay the bills as presented was made by Mr. Kirby and seconded by Mr. Jennings. Motion carried unanimously.

CORRESPONDENCE:

Mayor Moore read a letter in its entirety from Boone County Planning Commission Executive Director, Kevin Costello. The letter contained information regarding review of Zoning Amendment requests before annexation by a city. No action was required.

CITY ENGINEER REPORT:

City Engineer, Willard H. Rusk reported on the following:

  1. Had talked to Skyline representatives and P & Z about getting something done to keep water off of Calvary Drive. Mr. Erpenbeck had tentatively agreed to place a berm, which would function like a detention pond and all water to flow through a small pipe into the curb on the side away from Skyline. Talked to Wayne Erpenbeck, who had been aware of the problem, but as of yet no action has been taken. There will be some grading and a catch basin to prevent water from going out on US 42; Skyline has agreed to do this proposed repair work.

  2. Regarding the request to check on light fixtures at Lassing Green entrance. Replacement cost would be around $250.00 each, probably can get someone to install the two for around $200.00.

  3. Looked at the City flag pole location to see if the 25ft pole would be appropriate. After checking some other locations and the fact that higher poles are more expensive, I still suggest the 25ft.

  4. I have been to Whispering Trails almost daily to check on driveway work and they don’t seem to be progressing as quickly as they should. After e-mails, correspondence he received, a promise that the forms will be finished and. hopefully tomorrow concrete will be poured. I am more concerned of the dirt etc. on the street being cleaned up, as I have received numerous complaints from residents.

  5. Received a check from Adams for their part on the Sanitary Sewer and a letter should be delivered to the Sanitation District tomorrow. After recording, a copy will be sent to the City for our files.

    The Sanitation District is getting ready to replace the lift pump station that is located there, so Mr.

    Holt’s yard will be torn up again.

  6. Will be meeting with Mr. Berling probably this week or next regarding the detention pond problems behind Kroger. Had received a written complaint today. Had met with Mr. Creech on Friday, he stated that he had been told by Paul Buchanan and Boone County Public Works that no permanent improvements could be completed: however, as long as he was outside the 20 foot easement it should be okay for him to work on his yard. I will find out for sure and feel if everyone does what he or she needs to do, the problem can be worked out.

  7. Mr. McCormick said that the Dodge Daytona car had not been moved yet, but Col. Les Hill, will work on removal of the vehicle. Attended the GIS meeting and believe the program is very helpful.

  8. Concerning the request to review the snow plowing in the cemetery, the main concern was the use of the melting compounds damaging the grass and trees. After discussion of the contract, the Mayor asked the City Attorney to type in addition a paragraph regarding environmental safety for the Union Rice Cemetery and whether the cemetery needs the same priority for snow removal as the City parking lot.

  9. Mr. Jennings questioned the oil dumping in the Ivy Pond subdivision. The recommendation was to put together a note to the people in the general area that this act was illegal. This violation would subject the guilty person to being fined by EPA.

  10. Mr. Baker will be informed not to mow any more this year.

PLANNING & ZONING REPORT:

Mr. Randy Barlow, City of Union Representative reported that the Public Hearing for a manopole on the Lewis Farm property that had been deferred until January. Developers are trying to find another location.

OLD BUSINESS:

Mayor Moore reviewed with the City Commissioners the layout, prices, and different light fixtures and poles that are available for the Lassing Green Subdivision from the proposal received dated November 16, 2001 from Michelle Kolb, Customer Project Coordinator Cinergy/ULH&P. After discussion the Commission agreed to go with the Town & Country/Fiberglass Pole with the High Pressure Sodium (yellow, softer light) versus the Mercury Vapor (white light) at the cost of a monthly charge $267.92.

NEW BUSINESS:

Mayor Moore read the two proposals received for the snow removal for Winter 2001/2002 for the city building and the road in the Union Rice Cemetery. Mr. Larry Bowman bid $55.00 for the City Building, $45.00 for the Union Rice Cemetery. Each location is per occurrence. Mr. Joe Menefee, Menefee’s Lawn Care bid $75.00 for the City Building and $65.00 for the Union Rice Cemetery. After discussion Mr. Jennings made a motion to accept the bid from Mr. Larry Bowman for snow removal for the City Building and Union Rice Cemetery and seconded by Mr. McCormick. Motion carried unanimously.

At this time Mayor Moore recognized Col. Les Hill, Boone County Sheriff Department. Mr. Hill was present tonight to offer assistance from their office to attend the Union City meetings on a regular basis to answer questions. Also requesting assistance from the City of Union to open a Sheriff sub-station here at the city building, similar to the two sub-stations that are set up at the City of Walton and at Richwood. They use the City of Walton city building 24 hours a day and would greatly appreciate the use of the Union City Building for the same purpose. Mayor Moore commented that this has been discussed many of times over the years and thinks that the residents would like to have the police presence. Mayor Moore told Col. Hill that the City would cooperate fully by providing use of phone fax lines and computer if necessary. There will be a combo lock installed on the entry door for their use. Any items needed, just provide a list. Col. Hill feels the department can provide good service to the City as they are starting a new program for specific work in subdivisions by using detailed units for the various needs. Any particular problems they will be glad to look at them. After much positive discussion, Mr. McClellan moved to approve an EXECUTIVE ORDER 2001-001. ALLOWING THE BOONE COUNTY SHERIFF DEPARTMENT TO USE THE UNION CITY BUILDING/MAYOR’S OFFICE AS A SUB-STATION. Seconded by Mr. Kirby. Vote was unanimous. Mayor Moore presented Col. Hill with an immediate problem concerning complaints received from Union Village residents about the noise from Kroger, mainly noisy delivery service at late night and early morning hours. The City has just passed an unlawful noise ordinance. Col. Hill stated that an order would have to be issued from the city to authorize enforcement of the City of Union Ordinances. Attorney Voss will provide the proper documents.

Michael Morgan, Director of the Union Fire Protection was present informing the Commission of the numerous changes in the feasibility study, the largest geographic in Boone County. He was requesting information regarding water and sewer progress. Mayor Moore had spoken with Judge Moore about the progress on the Sycamore Sewer Project. The holdup has been property owners not signing easements.

The Sanitation Department will proceed to file Condemnation orders on those properties soon.

Mr. Kirby moved to adjourn the meeting at 8:38 p.m. Seconded by Mr. Jennings. Motion carried unanimously.
